Student Visa Extension – Errors on Application Form

hi Denial,

Just want to share with you my relevant details. It is like this: I had applied for my extension of student visa in march – 2010 ( end of the month ). now the problem is at the time of writing or filling the important details in the said form, By mistake or whatever my bank details has shown some fault in sense of writing wrong sort code or account no. I had maintained the required balance indicated by home office as it is up to the required time period. i did not have any proof of my application which I had been filed for my extension visa. Now from the home office , I received a letter containing the fault in my bank details after completion of 3 months duration. They sent back whole file returned back to me at my address.i just want to ask that if i have to put my file again, can i have to maintain the balance i.e. 1600 £ again ? is it essential to be maintained the balance or not? pl. advice. Am i overstay in such a situation? also be guide in such circumstances. They are not specified any time duration limit in the letter. pl. tell me what to do with that issue ? in the letter, they stated out 2 sections i.e. HC395 and para 34A. being a layman , i am not aware of it. pl. guide me about that ASAP.thanks

  • Hi I applied tier 4 visa extension,home office sent me confirmation letter Buh my name spell is totally wrong on that letter. So pls tell me what should I do now, because its home Offica fault not mine.Dose it affect on my extension case?

    My name is Lee. I need some advice, I applied Tier 4 student visa extension but I did not have enough maintenance fond and they refused and send me the appeal. I appealed and send them new banks statement and school receipt shown that I paid in full. I paid my fee Oct 18 and my visa extension decision was maid in Nov 3 2010. I tough that could help me but they refused me again.Same as first not enough fond and said not enough evidence. Even tough I had not enough fond I sent full bank statement but some reason they lost 8 days of evidence from banks statement. They sent me new letter saying that I can appeal upper court. If I can apply again with new CAS instead of appeal

  • My name is Moazzam Iqbal. I submitted VAF9 from and PBS appendix 8 TIER 4 (General) student Self Assessment form with my complete origional documents.Mistakenly i made the following human error in my applications form.

    1. I entered the wrong date 11/02/2011 in my application forms.It should be 11/01/2011.

    2.Mistakenly in TIER 4 (General) Student Self Assessment form i didn’t put a cross in the box of part 5.1, and 5.4.

    Kindly forward these correction to concern department/staff.In this regards your cooperation is appreciated.

    Please let me know that what would be impect of these errors on my visa process.

    HOW MANY DAYS NEEDS TO PROCESSING ?

    my question is-
    1. CAN I APPLY MY STUDENT VISA APPLICATIONA AGAIN?
    2.CAN I MAINTANCENCE £1600 28 DAYS? (I PAID FULL FEE)
    3. RIGHT NOW I M OVERSTAY ?
    4.UKBA WROTE LETTER ON 24 JUNE 2010 AND I RECIEVE AT HOME 28 JUNE 2010, WHEN I SEND MY APPLICATION ?
    5.I START MY BALANCE £1600 ON MY ACCOUNT 30 JUNE 2010 AND 27 JULY , MY 28 DAYS FINISH, THEN AFTER I SEND MY APPLICATION.
    6. CAN I NEED NEW CAS LATTER YA OLD CAS LETTER IS VALID?

    • Hi Jay

      You need to look carefully at the documents the Home Office have sent you. Have they permitted you to make another application? Have they told you you must leave the country?

      If you apply again, you will need to fulfil all the criteria of the application. So, you will be subject to the same maintenance requirements.

      You should submit your application ASAP as you currently have no valid leave to remain in the UK.

      You will need a new CAS number as each one is only valid for one application. Check this with your sponsor.

      Given the details of your case, it would be worthwhile to discuss the details with a fully regulated immigration lawyer, details are available from the OISC.

  • Immigration Rules HC395 – paragraph 34A states:

    34A.Where an application form is specified, the application or claim must also comply with the following requirements:

    (i) the application or claim must be made using the specified form,

    (ii) any specified fee in connection with the application or claim must be paid in accordance with the method specified in the application form, separate payment form and/or related guidance notes, as applicable,

    (iii) any section of the form which is designated as mandatory in the application form and/or related guidance notes must be completed as specified,

    (iv) if the application form and/or related guidance notes require the applicant to provide biographical information, such information must be provided as specified,

    (v) an appointment for the purposes stated in subparagraph (iv) must be made and must take place by the dates specified in any subsequent notification by the Secretary of State following receipt of the application, or as agreed by the Secretary of State,

    (vi) where the application or claim is made by post or courier, or submitted in person:

    (a) the application or claim must be accompanied by the photographs and documents specified as mandatory in the application form and/or related guidance notes,

    (ab) those photographs must be in the same format specified as mandatory in the application form and/or related guidance notes, and

    (b) the form must be signed by the applicant, and where applicable, the applicant’s spouse, civil partner, same-sex partner or unmarried partner, save that where the applicant is under the age of eighteen, the form may be signed by the parent or legal guardian of the applicant on his behalf,

    (vii) where the application or claim is made online:

    (a) the photographs and documents specified as mandatory must be submitted in the manner directed in the application form and/or related online guidance notes and by such date as is specified in the acknowledgement of the online application,

    (ab) those photographs must be in the same format specified as mandatory in the application form and/or related guidance notes, and

    (b) the confirmation box (which states that the information contained in the application form is true and complete) must be completed by the applicant or, if the form is completed by an immigration adviser on the applicant’s behalf, by the immigration adviser on specific instructions from the applicant that the information given is true and complete, and

    (viii) the application or claim must be delivered in accordance with paragraph 34B.
