No Refund From ASIC Accredited College – Crown International College, London

I am an International Student from India. I had applied to “Crown International College, London”, (an ASIC accredited college) for a course. I paid them the full tution fee and the college issued me a Visa Letter. But unfortunately my visa was rejected and I could not join Crown International College to pursue my course. I subsequently applied for a refund of my tuition fee to the college but they have not refunded my fee. It’s been few MONTHS now that I have been following with the colllege but the college is not entertaining my request for thr refund. There are 12 more friends of mine who have suffered the same thing from Crown International College, London.

Please advise me what is the recourse available to me and my 12 friends to get our refunds from the college and is there any way in which ASIC can help us in getting our refund from Crown International College, London.

  • Dear All

We had a meeting in our agents office and have told them about the name of the solicitor and his phone no. in Uk. We also told them to write to all the accredition agency with which crown is registered. But our agents have told that Andrew Curtis the principal of the college has told them that he will be refunding the money. Our agents have told us to wait for a week’s time.

    We are ready for action.

We thank everybody here on this forum. Your advises have been very helpful.

    • Hi Kawaljeet

If I were you I would have your solicitor send a letter to Mr Curtis explaining that you’re expecting your money in 1 week and that if it is not received proceedings will begin.

This should make sure that Mr Curtis doesn’t “forget” to process your refund.

Keep us posted on you get along Kawaljeet, nice to hear some better news.

  • We have got extreme help from the agency that we had applied through. We have got an email today from them that was sent to the college Pricnipal. Our agents have provided Andrew Curtis all the documents that he had asked for. They have been following with him for months now.

We all students are meeting on Sunday in our agents office and decide on the hiring of the solicitor.

All of you who wish to take contact us may post their email address.

    • Keep us posted on how it goes; I think I replied to a newer comment where you said you’ve decided to hold off action as the college have said you’ll have your money in a week. Beware of delaying tactics, would be my advise! It can sometimes help to send them a letter outlining your intended action so they: a) know your serious; and b) won’t forget your refund in a week’s time!

Looking forward to your updates Kawal and best of luck to you all.

  • Hi Kawaljeet

I suggest that you also ask your solicitor whether there is any liability on the part of ASIC. After all, they gave accreditation to the college.

I believe that it is time those who give accreditation to colleges should be held accountable. They charge HUGE fees for their services but the monitoring and taking responsibility aspect needs to be carefully analysed.

Well done – you are an example to us all in your fight for the Rights of those who have been victimised by dishonest people.

  • Daniel/Bruce,

Please see the below template for your perusal.

    Cheers,

    ROn

    Dear BHC Immigration Dept.,

I hope this letter serves you well. I’m contacting you with regards to my Tier 4 – Student Visa application that has been lodged on (“Date”). Since the aforementioned date, I haven’t received any staggering progress on my Visa request and that troubles me a lot as my course intake date is drawing near.

I understand that your Immigration dept. is inundated with high volume of visa applicants and for some instances the processing time may be lengthy. However, there are certain service level agreements in which your office needs to satisfy in order to provide an amenable customer service to both your applicants and to UKBA as this will be your benchmark to measure your performance.

As a student, it is an integral part of my responsibility to furnish genuine and verifiable documents required standards set by the Point Based System. I regard this as one of the pliable ways to be of help to your agency during the post-visa stage.

Nevertheless, should you encounter any difficulties in processing my application don’t hesitate to contact me as I’d be more than willing to accommodate your request to alleviate any deferment on my application.

Looking forward to getting you immediate response.

    Many thanks,

    “Sender”

  • This standard refund policy is from Crown International College London website under Policies and Procedures, so that is what should apply:

    14. In the event of refusal of a visa, tuition fees will be refunded (not the registration fees) subject to an administration charge of £200, provided that all original documents issued by the College (acceptance/enrolment letter, receipts), proof of rejection of student visa (a letter issued by the British Embassy/High Commission Authorities, confirming the refusal of visa/entry) and photocopies of all the pages of the passport are returned to the College. All refunds will be made in UK Pounds (£).

    • Dear Joe

That precisely what i was saying that in the event the visa is refused it is beyond the control of the student to join the college and therefore it entitles the student for 100% tuition fee refund.

Thanks for your information and thanks to everybody in this group who are helping the cause of international students.

We (I and my friends whose visas have been rejected) are pooling money to take care of the cost of legal action ifthe college authorities still persists on not giving the refund.

    • Hi all

Can you please suugest us the name of some good solicitor around the area where the CROWN INTERNATIONAL COLLEGE is situated. We will have a word with the solicitor or write to them and appraise them of our case before our representatives arrive in UK to pursue our case.

It will be a great help.

  • Hi Kawaljeet

Google ASIC / HOME OFFICE MINISTER / SUN NEWSPAPER and the information you seek will be there.

It is vital and important that the UKBA and other bodies are kept aware of what is happening on the ground – reports will not pass unnoticed.

    • I agree; I’ve asked Ron to work together to create complaint templates that can be forwarded to all relevant bodies to make it easier for those affected to submit their complaint.

I’ve also been speaking with the UKBA regarding their work in this area. I’ll be making an announcement very soon. Unfortunately, I can’t go into to many details now but please believe when I say that the UKBA takes these issues very seriously and is working very hard behind the scenes.

    • Hi Subhash,

We are also experiencing the same traumatic events here in the Philippines from most of the colleges back in London.. Apparently, some of the students are now starting to realise that London is now becoming less attractive to go to for Education/immigration purposes.

Nwei, I’ve managed to obtain some of the contact details that you needed. Kindly skim through the below details for reference.

*The incumbent ASIC chief executive is Maurice Dimmock. You can email your concern to katem@asic.org.uk.
*The Minister of Home Office for Immigration is Damian Green. You can send your complaints against the education providers directly to the below emails.
      MigrantReporting@ukba.gsi.gov.uk & SponsorLicensingEnquiries@ukba.gsi.gov.uk

I hope at least this will save you some much time to suffice what was already been wasted by your college.

      Regards,

  • Recourse available to you is – FORGET YOUR MONEY. No college in UK is refunding money except very few. Most of the times refund is a big issue. Further if you talk to UKBA they say it is a COMMERCIAL matter-deal between College and Student and government can not do anything in it. Talk to your agent and do followup. My advice to all students – Always Use Services of agent who provides facility of Payment of Tuition Fees after Receipt of VISA. There are many in Gujarat who are good and provide this facility.

All the best for your efforts to get your nmoney back

    • Subhash, this is just not true.

The majority of colleges provide refunds in accordance with their terms and conditions.

There are a few bad colleges who are not providing refunds.

Another benefit of using an agent in your local country is that you have someone you can put pressure on and potentially take legal action against, with a much higher chance of success. If you make payment to an agent, a contract is formed between you and the agent, meaning you may well stand a better chance of getting your money back. Any agent worth their salt would do all they can for students and put immense pressure on any college that does not provide a refund.

I would not suggest only paying a deposit against tuition fees as in some cases this can go against an applicant when they apply for a visa. Applicants who do only pay partial fees must remember that they will have to add the remaining balance to the required maintenance funds when preparing their financial statements.

  • Hi

    I suggest the following:

    1. Contact ASIC and make your complaint. They have a code of ethics to observe.

    2. Contact the HOME OFFICER MINISTER – outline the problem.

    3. Consider writing to The Telegraph / The Sun Newspaper.

Let me know how you progress.

Like or Dislike: Thumb up 0 Thumb down 0

    • Can you please prvide me with the email id of the relevant department of ASIC, Home Officer Minister the Telegraph and the Sun Newspaper.

Well af far as getting the refund is concerned I do not mind to come down o UK as well and hire a slicitor. I do not mind paying and spending more than the refund amount to bring these frivilous college and frivilous people to justice.

It is a matter of Principle. How can they keep my money if they havenot prvided me the services. With every Interatonal College the rule of refund is that IF THE VISA GETS REJECTED THE STUDENTS ARE ELIGIBLE FOR REFUNDS.

I will Fight it to the Logial Conclusion so that no more students suffer the same plight as I did.

I hereby through this forum request you all if you can be of any help in getting my refund. My parents are not filthy rich and it is their hard earned and hard saved money.

      THANKS

      • If you don’t mind me asking, what reason was given for your visa refusal? And that of your friends?

Given you know so many people who are all in the same boat, a joint action from the 13 of you may well be the best way to go. I find it disgusting when colleges do not provide refunds which are valid.

I’m hoping to draw up some template letters with other members who post here to make it easier for people to get involved with complaints.

Do you think you could begin collecting evidence from your friends? Copies of documents, such as invoices, TT transfer receipts, any correspondence from the college, reasons for refusing to process the refund, refusal documents from the British Embassy etc.

I’m keen to help you in any way possible.

        • Dear Daniel

The reason given to me for the refusal was that my visa letter could not be verified. All my friend have the copies of the Demand Draft sent to Crown International College’ London.

My understanding is that if the visa is rejected the student is eligble for 100% Refund.

I had couple of my friend’s visas were rejected for Australia. And believe me all of them got the refunds in no time. I do not why we are not getting our refunds.

May be the Crown International College’s owner wants to make money without imparting the edcation to the students.

My agents makes international calls to the college and have already spend a lot of money following up for our refunds and it seems that the college have turned a deaf ear to it.

We all are planning a Joint Action against the College. It’s a matter of Principle. My agents have suggested that all of us should collectively complain to the British Home Office through the British High Commission. We are even planning to hire a Solicitor and besides the fees we are also planning to claim the damages from the college.

Please let me know your opinion on this and any other alternatve if you suggest.

          Regards

Luckily for me they have always communicated through email and I have emails from them saying they will pay on such and such a date and end up not paying but constantly come up with excuses.
I have made a complaint to Asic and the home office. However the whole process is slow. Is there no way we can all make a joint complaint to watch dog or any newspaper in the uk to expose such colleges? I’m thinking of writing in my local newspaper at home about the college as they too have agents in my country

    • I would add the following:

Write to the college and explain that if they do not provide you with a refund, you will commence legal action. If the money owed is over £1000 and you can secure a judgement against them in the County Court, you can apply for what is called a Winding Up Order. This essentially will force the company to be struck from Companies House, forcing them to close – the reasoning is that they do not have money to meet their liabilities. Plus, if they refuse to pay you even after getting a judgement against them, you can send in Debt Collectors, which might give you a warm and fuzzy feeling inside and put a smile on your face!

More often than not, by demonstrating that you know your rights and the mere threat of such action should speed up your refund immensely.
