I have a friend who applied for a visa last november 2009 and until now the BHC still has it.what we dont understand is some of the others who have the same visa application date with my friend got their visa results in 3 days, 10 days and 14days. Luckily for them they were able to join the jan21 intake of the school.
One reason why it was delayed is due to the sponsors license(jan.19) suspension which was lifted last march 4 2010. My friend was deferred to the soonest available uptake which is May 20 2010. Following the new rule that a student needed to have a CAS number, my friend was reassesed by the school, if my friend is qualified to be taken by the college. And my friend passed the rigid assessment and was made to pay for the full tuition fee.
Continuing this further, the college already emailed the BHC the students’ CAS number and BHC told the college sponsor that they are already processing the application. Unfortunately my friend still has not got visa result and missed the May 20 2010 uptake.
Now my questions;
a. How may months should they be pending the visa application? Knowing that the student already submitted the necessary requiremnts?
B. How many months can they fully investigate that the documents that a student submitted are all genuine considering that the student was already screened by the college.
C. Are the ECO not considering the date of the uptake of the students? And so they can just pend it and not prioritize it? The student if cant make it with the start date and the date stated in the Cas will have to reapply again for a Cas number. why are they not considering it and process the application?
An email from BHC correspendence says that they cannot give a definite time as to when the application will be released because they have to tighten the investigation due to the large numbers of fake documents in similar application was discovered. So what do they by this?
Students will be waiting for like 5, 6 months or worse a year and only to have a result that is denied because of the CAS number is no longer valid. And that they have to reapply for another Cas and reapply for another visa. the delay of the visa result is not totally the students fault and same with the unable to make it to the start date of their classess.
Please help student who are under this kind of circumstances.
Thank you.

I lodge in the vfs last june and I am refused because my bankbook account balanced was more than 1 mos. to the date of my application but together with that said application I provided An up to date bank letter and transaction history. I think it should be their responsibility to double check with my bank if my balance is really existing, not that they are very fast in issuing refusals on the other hand they are too slow in issuing visas. In the hope of getting visa faster I updated my bankbook and file a fresh application the next month instead of filing an appeal but nothing has changed up to now I didn’t receive any update..Whats wrong with the embassy? Anyone can conduct fast and thorough checks on the veracity of documents without sacrificing too much time and effort. Visa fees hike continuously but their service is still slow..

I have lodged my papers at VFS Global Makati last March. Its already 4 months and the embassy is still very silent about the result of my papers. My intake (May 2010) has already lapsed, as indicated in the CAS.
My question is that, what is causing innefficiency in the BHC? What can be done in order to reduce the excuses of the BHC and to lessen the ruined lives and dreams caused by BHC? What can be done to get BHC back to work and consider visa applicants as human beings? What hope is there for visa applicants who are abused by the embassies, not only the British Embassy in Manila but also others.
Well, let us say that in protecting their welfare as a country, they are already causing pain and consciously and unconsciously destroying the welfare of genuine students.
How would British Embassy Manila justify their faulty operations? How would they ever justify their erroneous local interpretation of the rules they did?

Hi Mar
Have you tried raising the delay as an official complaint? They are obligated to provide you with a reply inside strict time-frames. Just something to consider. And good luck.
Keep us posted on your situation, hope it all works out positively.

Daniel/Bruce,
Please see the below template for your perusal.

Dear BHC Immigration Dept.,
I hope this letter serves you well. I’m contacting you with regards to my Tier 4 – Student Visa application that has been lodged on (“Date”). Since the aforementioned date, I haven’t received any staggering progress on my Visa request and that troubles me a lot as my course intake date is drawing near.
I understand that your Immigration dept. is inundated with high volume of visa applicants and for some instances the processing time may be lengthy. However, there are certain service level agreements in which your office needs to satisfy in order to provide an amenable customer service to both your applicants and to UKBA as this will be your benchmark to measure your performance.
As a student, it is an integral part of my responsibility to furnish genuine and verifiable documents required standards set by the Point Based System. I regard this as one of the pliable ways to be of help to your agency during the post-visa stage.
Nevertheless, should you encounter any difficulties in processing my application don’t hesitate to contact me as I’d be more than willing to accommodate your request to alleviate any deferment on my application.
Looking forward to getting your immediate response.
Many thanks,
“Sender”

Good luck to you because there are no CAS being issued for the Philippines until this date. VFS Makati keeps accepting application for money. Is the UKBA that low that resort to this kind of scheme?

C. Are the ECO not considering the date of the uptake of the students? And so they can just pend it and not prioritize it? The student if cant make it with the start date and the date stated in the Cas will have to reapply again for a Cas number. why are they not considering it and process the application?
This is a very good question that the ECO themselves should addressed as there are loads of non-settlement applicants here in the Philippines that needs to be concluded on the stipulated timeframe set by UKBA. What bothers me most is the current data for decisions made in April 2010.
The report shows that ONLY 279 decisions was made in the month of April, which is almost 60 per cent lower than the 620 decisions made in February. If they are saying that they need to double their effort to identify fraudulent documents, I don’t think that genuine students should be affected by such procedures performed by them.
They can basically do this without involving all of their applicants. Why not make a dedicated team/committee to carry out such task so that they can proceed in processing genuine applications?!!!
Well, I’ve put the above into writing and forwarded it to the embassy here in Manila so that they can investigate further or assess what needs to be amended on their current procedures. I’m just hoping that they would heed some of the feedbacks sent by their applicants in order to re-evaluate their processing guidelines.

Hi Ron
It’s really encouraging to read that you are taking such positive steps in addressing the route causes of the problems you and your fellow countrymen have been experiencing. Do you think I could see a copy of the letter that you have sent to the High Commission? Perhaps we could get everyone to sign and send a copy adding even more weight to the complaints.
I’ve also been encouraging everyone who has been waiting any longer than the published guideline processing times to raise official complaints – perhaps we could work on a well worded template to make complaining so much easier for everyone concerned.
The situation really is unacceptable and I hope that action will lead to improvements for all.

I couldn’t agree more! this must be taken seriously by the High Commission as their Key Performance Indicator which is the Customer Service Standard is no longer meeting it’s Service Level Agreement with the UKBA.
Unfortunately, for security purposes i can’t guarantee you that i’d be able to share the letter i’ve furnished to the Embassy. nevertheless, I am more than willing to assist you in finding ways to remedy the highly debatable measures being performed by the High Commission.
I have you on skype and will message you to talk this through further.
Regards,
Ron

Hi Ron
Thanks for coming back to me.
I’d of course expect you to edit out any references to your name, address, DOB, passport info, application references etc. I’m just interested in the framework of the letter as opposed to your personal details! Rest assured, I consider personal data to be just that, personal!
Just noticed your Skype reference too – we can discuss further there as you suggested.

I’ve already dropped you a message on your skype (adviceforyou) but to no avail.
Also, I think one of the “bestest” way to address such issue is for EDUCATION PROVIDERS to keep track of the status of the visa application made by their students, and chase it themselves!
The idea of this is for schools and the High Commission to have a direct communication so that if BHC has already met it’s visa quota for a specific month, the education providers need not to accept further students and they can easily relay that to the applicants going forward.
Nwei, I already received the response from High Commission about the enquiry that ive made about my application the other day. Please see the below statement from them.
Your email has reached the Visa Enquiries Team at the UKBA Regional Visa Section for the Philippines, Japan, South Korea, Hong Kong, Taipei amd Brunei.
We have received your visa application to study in the United Kingdom. The UK Border Agency continually checks and monitors all applications to ensure they meet the required standards set by the Points Based System. As a result of this on-going process, your application is one of many that has been deferred pending further checks. Until such time as to the outcome of these checks are known, we are unable to inform you how long this will take. We will contact you again once all checks are completed and your application has been processed.
Please DO NOT reply to this email, or try to contact the British Embassy about your application as we are unable to provide you with any further information at this time.
Yours sincerely

THE ABOVE SEEMS TO BE AN AUTO GENERATED EMAIL AND NOT EXACTLY THE ANSWER THAT IM LOOKING FOR…

Got my appeal overturned last dec. 15, 2009.
Submitted my passport for visa stamping last jan. 29, 2010.
I made a letter to embassy in mid of february asking why it takes too long to wait for the visa to be stamped. Embassy told that my passport was deferred from visa stamping due to pending UK investigation on my school.
However, TPDU is still in UKs register of license of sponsors in February until 3rd week of March 2010.
On March 29, 2010 TPDU from derby got their suspension and removed from the list.
June 1, 2010 I got my passport back, saying that they cant give me visa for TPDU has lost its license or revoked recently. Aside from passport and letter of transmittal, there was another refusal letter attached with new date of application, reference number and name of new ECO who refused my visa stamping process and another admin request form. Seems i applied for fresh application though i were not.
My question is, Does UK embassy manila has a right to do that and forcely obstruct me to have an entry clearance though i got overturned refusal already?
I have the appeal form here and gave me 28days to file admin review request. However, TPDU has lost its license. Please give me advise asap.

Hi Miguel
As far as I’m aware, when a sponsor’s licence is suspended, the BHC should put all pending applications on hold. Does your new visa refusal clearly state that your sponsor has had their licence revoked? Do you think you could provide me with a copy to read?
The problem is that they can’t issue a visa whilst their licence is suspended. However, there are clear inconsistencies with the dates, which you could bring up in a review, along with the fact that your application should have been placed on hold until the suspension was resolved.
Are you in a position to use your refusal documents to get a refund from the college and apply to a new education provider?
