Dear Daniel
It is really appreciated that You always reply to everybody with giving every solution, without any charge which is very exceptional in today’s
thats why every body know you and respect you.
I am from India. I applied for UK Visa (T4) general on 19th Feb and got refusal notice on 28th April,10.
ECO Comment.
“YOU HAVE PROVIDED BANK STATEMENTS FROM UBI AND ALLAHABAD BANK. HOWEVER THESE STATEMENTS HAVE NOT BEEN CONSIDERED AS THEY ARE OVER A MONTH OLD. I AM THEREFORE NOT SATISFIED THAT YOUR HAVE ACHIEVED 10 POINTS… I THEREFORE REFUSE YOU APPLICATION UNDER 245ZV(C). THIS DECISION WAS MADE ON THE MERITS OF THIS APPLICATION. HOWEVER, IF YOU HAVE A PREVIOUS APPLICATION AND IMMIGRATION HISTORY, THIS MAY HAVE BEEN CONSIDERED”.
(T4)Application date was 19th Feb 2010.
I had shown(closing balance)over a month old last statement–
UBI on 23rd sept.09 and
Allahabad as on 18th Nov09
because I didn’t made any transaction between last statement dates and application date and that because bank didn’t want to put any statement in bank’S PASS BOOKS on 28days prior to the date of my application. And I still maintained my banks amount till now which amount I had claimed in my application form which I can demonstrate also if A.Reviewer will ask.
I had applied for AR which is received on 17th May10. Now I am waiting for the outcomes and still now no result
I already got 5 times UK visa on sports visitor category.
dear I already suffered to getting my T4visa result with taking 2 months 2 week. Can you suggest me what i will do if my AR will delay (already 28days crossed)???
and where UK border agency mentioned that if in exceptional circumstances, of delay of A.R with in 28days they will notify me in writing as to when to expect a decision but WHY THEY ARE NOT MAINTAINED WHICH THEY ARE MENTIONED… ??
Dear do YOU feel my A.R application is strong or not..???
This post was submitted by Federico Klebe.
Thanks for your time and effort to shed some lights into Uk Visa related issues
I have submitted an application as a tier 4 dependant for over five months now and till date i have not recieved any information on it. In this case what do i do? If I contact the UkBA on the status would this approach have any negative effect on the decision? Looking forward to hearing from you.

Um Hi Daniel,
I know that you are being bombarded with questions on this page but i would really appreciate it if you could answer a question of mine. Im from Sri Lanka and applied for Tier 4 Genereal Student Visa in September. It was rejected the first time because my bank statements were not within the month of my application. I reapplied but once again failed because my CAS (which I reused) was invalid. My uni (university of Leeds) has deferred my entry to Sept 2011. I am worried that my 3rd application next year will be rejected due to the prejudice derived from my earlier rejections. Will this happen or will I be granted my visa as long as my documents are all in order this time.

if you have latest CAS latter and required funds (maintaining 28days), You have no problem..
remember U are not refused in general ground. so prejudice is no matter.
be aware.. in funds — Bank logo, manager sign, and bank stump is must.
although have look latest rules and regulation of UKBA.

Dear,
i am student of greenwich university, i am in UK since 2001.my husband and my 8 years old son (born in UK) both are my dependent. 2 months back my husband applied for his 10 years long ILR as he is in UK since 2000.but what makes me worried is that due to some reason i couldn’t attened few classes,i am afraid if my university let homeoffice know about my attendance will it effect my husband’s ILR as he is my dependent? though i am student of this university before this CAS (Confirmation of Acceptance for Study)system was introduce and still have got my visa till nov 2012. if my uni decide to let homeoffice about my attendance then will they let me know before they going to do it and will it effect my husband’s ILR ? pls reply me.

Good Day!
My name is Arsen and i ‘m from Ukraine, i am 21 years old and finishing law academy.
I applying for Tier 4 student visa ,i passed interview with college(level is B1) and paid fees in full(waiting for document) .I have money in my account to cover living expenses (800 pounds per month)my course is 6 month. Hope this will be ok, however i had two refusals for student visitor visa before. First one is basically saying that i want to travel during my studies and I didn’t provide prove that my university know about my trip and for this period they will keep place for me. Second refuse was based on my Mum’s bank statement .as was said in refusal letter: As the results of checks made by this office, detailed in a DVR,i am satisfied that there is high degree of probability that this products is not genuine .I am therefore satisfied that you have submitted false document in support of your application. Your application is refused accordance to paragraph 320 as stated above .this is mondatory refusal.
This bank letter was real and my Mum has accounts in this banks (we have prove of it) I don’t know what happened there. However I have documents that could support that this letter was real. Do I have to provide them with my new application?
And what is your opinion regarding my situation?
Can they consider my immigration history and refuse my new application based on previous refusals?

hello Daniel
I have applied for student Tier 4 visa and it has been rejected stating the only reason that i have not enclosed the bank statements which bear logo on it. Now i have rectified my documents and took my account statement on a HDFC bank logo sheet with adequate stamps on it. I have also taken a balance confirmation letter as on date before applying. Luckily i came to know that the CAS letter can only be used once and therefore i have requested my college to issue a new cas which they did and i have enclosed new cas.
Now am worried whether it would please the visa officer or not? i have all my documents according to the published guidance of tier 4 policy.
the first refusal letter only stated the want of logo on my bank statement and nothing else. If any other discrepancies are noticed, would they have been mentioned in the first refusal itself or can they mention it after re applying. All my documents are same as first except the bank statement and CAS.
kindly advise.

Hi, I am phD student at University of Leicester and want to bring my wife and three children as dependent.to my understanding I have to show 400 pounds for each 4 of them for 9 months. Should I show it from my pakitani bank while i am here and cant bring the money here plus do I need the accomodation contract where I will keep the. Many of the people are saying to me that the accomodation contract is now no more required by UKBA and they only need the bank statment,my visa and passport entry page.
Please advice accordingly.

Hi Daniel,
I am a third year phd student at nottingham university. came in the UK in 2005. obtained MPH and MSc epidemiology at bedfordshire and Brunel universities respectively. applied for tier 1 visa while on PhD course in december, 2009 but application was turned down on grounds of funds. i had the opportunity for the hearing at a tribunal and this was also turned down. In may i applied for a student visa but was only awarded 30points. 10 points for funds was rejected because my lawyer sent the application one day late. In all my applications i used foreign bank statements but non was acknowledged. Can i make a new application? I have money in my bank account but not enough for the 2 month as per requirement- if i was to reapply, can i do so without the bank statements-intend to send them a bit later or otherwise it will be turned down on same grounds. How do i buy to time to complete my PhD-

Hi Sami
If your course ends earlier than expected (because, for example, your education provider has cancelled your place on the course, or you have finished the course early), your permission to stay will be limited to 60 days. But it will not be limited if your permission will expire in less than six months anyway.
Given you have more than 6 months left on your visa, your leave will be limited to 60 days. The UKBA should contact you. During this time you are free to change sponsor and will need to make a new visa application.
Staying beyond 60 days and/or failing to arrange a new visa will mean you are in breach of your permission to stay.
How come your university have not given you the option to resit the exams you failed? What university are you studying at?
The maintenance requirements for a family member of a Tier 4 (General) Student depends on the following circumstances:
the length of the course;
where the main applicant will be studying in the United Kingdom; and
whether the main applicant already has an established presence studying in the United Kingdom.
How many months money does a family member of a Tier 4 (General) Student need
A family member of a Tier 4 (General) student must show that he/she has enough money to cover his/her monthly living costs whilst the student is studying in the United Kingdom.
The amount of money a family member has to show will depend on whether the student already has an established presence studying in the United Kingdom. Where a student has an established presence studying in the United Kingdom, the family member will need to show less money for living costs.
A student has an established presence studying in the United Kingdom if:
He/she has completed a course that was at least six months long within their last period of leave, and this leave finished within the last four months; or
He/she is applying for continued study on a course where he/she has studied at least six months of that course and has been studying within the last four months; or
He/she is applying to continue in Tier 4 as a Sabbatical Officer or as a Postgraduate Doctor or Dentist and he/she has completed a course that was at least six months long within his/her last period of leave, and this leave finished within the last four months.
A family member can qualify for the reduced maintenance levels whether he/she is applying from inside the United Kingdom or from overseas.
Where a student does not have an established presence studying in the United Kingdom, the family member must show that he/she has money for his/her living costs for each month of the students course up, to a maximum of 9 months.
A student with an established presence studying in the United Kingdom must show that he/she has money for his/her living costs for each month of his/her course up, to a maximum of 2 months.
The family member of a Tier 4 (General) Student where the student does not have an established presence in the United Kingdom
If the Tier 4 (General) Student is studying in inner London
The family member of a Tier 4 (General) Student who is studying in inner London must have £533 per month up to a maximum of 9 months, to support himself/herself.
If the Tier 4 (General) Student is studying in outer London or anywhere else in the United Kingdom
The family member of a Tier 4 (General) Student who is studying in outer London or anywhere else in the United Kingdom must have £400 per month up to a maximum of 9 months, to support himself/herself.

Dear Daniel,
Thank you for your reply . unfortunatly my uni cancel my registration and told me they wont give me any chance for registration in this course, though i made appeal against there decision and asked them to give me a chance for the repetion of the year. coz as i am an international student if i change my sponsor / institute then i have to apply for the visa again. where i have extend my visa last Feb 2010 and i received Nov 2012. so in my case what shall i do now ? and within what time ? i dont have much time to get admission for UK university so i am taking admission in UKBA A rated college.do i need to apply for visa again if i take admission in another college ? and when i need permission for the admission for that different institute ? pls tell me.

Hi Sami
Thanks for coming back to me.
What was the outcome of your appeal? I’m still quite surprised that they did not offer you the chance to resit your exams. Most allow this, but of course severley restrict the grade you will be able to achieve.
What university are you studying at?
I think that as your extension came after 5 October 2009 this brings you under the new Tier 4 rules. You should check this with the UKBA yourself.
If that’s the case, you will need to make a fresh application to change sponsor. The rules for changing to an A or B rated college have now changed: you will have to wait until you get permission from the Home Office before starting your course. If you are changing to a Highly Trusted sponsor, then you are able to start your new course immediately, but entirely at your own risk.
As your university has cancelled your registration they will have no choice but to report this to the UKBA. You should therefore give this matter your urgent attention and get your status sorted.

Hi my name is Lili and i’m from congo. I’ve been looking for advice on the internet and i’m really surprise that someone could take of his time and answer people for free. So thank you Daniel even if i don’t know you.
I have a problem hope you can give me the best of your advice.
I’ve applied for tier4 on june this year and have been refused the leave to remain as T4. The reason is that there is a gap of more than a month between the end of my visa 2nd of june and the starting of my course 5th of july which should have been 1month according to one of the UKBA laws that i didn’t know. But i’ve been awarded all the 40 points i claimed for. I’m thinking of appealing so please i need your help.
Thank you in advance.

Hi Lili
Unfortunately there is little you can do as you have fallen foul of the law I’m afraid. Your appeal will not succeed.
You should probably return to Congo and make a fresh visa application. Don’t overstay following this refusal as you could jeopardise any future return to the UK.

i have been refused tier 2 visa twice.once for the want of bank logo.when i submitted the account details with bank logo then they said the certificate of sponsorship is invalid.it can be used only once.
it is to note that if the bank statements are issued as per standard norms in india then this problem would not have arise.icici bank bluntly refused to issue me statements of my account with a bank logo.this was at ramdaspeth nagpur branch.ultimately i had to grease some hands to get across the statement which is truthfully mine.
still i am at a lost now again i will have to apply now that my certificate of sponsorship has become invalid.
waiting for the best.

Hi Hasan
I can only think that there must be many students all in the same situation; application levels are high, many are choosing to appeal given the UKBA’s interventions and I think it is slowing the whole process down. Have you written to them formally to ask why they have not made a decision for so long?
Also, what college have you applied to? Is it still suspended?

I imagine that there are many, many students who have decided to go down the AR route, so delays are to be expected.
Have you written to them formally to request an update on your application and to know why it is taking so long? I would strongly suggest doing so.

Dear Federico,
This is very common ground of rejection. Even your AR will be negative. I already have answered in past this problem. When you apply to BHC Your Finance Last Entry must not be more than One Month Old. ForEx. You are applying on 16th June 2010 then Last entry in your passbook must be on or after 17th May 2010. Means you need to apply in One month from Last transaction date.
Do not wait for your AR. Deposit 500 Rs. in account today and reapply with in one month – I assure you that you will get Visa if all other things are as per requirement.
Regards
Subhash
