Can a Tier 4 Student dependent work as Freelancer or Self – Employed?

Hi

My wife is a Tier 4 Student in London. She is a doing course in Health care NVQ 3. She is in London from November 2009. She has a work & study visa. Now I am in India working as computer programmer and planning to apply for dependent visa in next week. My query is can I work as a freelancer or self-employed in UK.

My second query is as my wife got Tier 4 Visa for UK before declaration of new rules, so for me dependent rules will be applicable as per new regulations or as per old one?

  • Hi,

I’m student in edinburgh since 2008. My visa will expired on 31 of January. I just apply for the extension visa together with my husband and daughter visa. I just wondering whether my husband can apply for job or not. Because recently I heard that the UK Border don’t allowed the dependent to work anymore while waiting their wife completing the study.
    many thanks

  • Dear sir/Madam,
I came here as a dependent and now i dont like to stay with him? Our visa is going to going expires in 15 December 2010 and i am living single since three months but we are not seperate legally, Its being time to expend our visa but he is demanding a huge amount of money to pay his fee which i cannot afford. If not he told me to buy ticket for home country but i want to stay more and complete mine studies as mine parents cannot tolerate mine this situation. so in this condition i wanna join college myself with that money, Is it possible or not? If possible what can i do?

  • Hi Daniel,
I applied for tier 4 dependent visa inside the uk, and got my visa yesterday, my wife is doing MBA and she was granted 14 months visa in march 2010, and i applied to be her depndent in june 2010, now my new visa is valid until may 2011 same as hers, but on my icfn it says no work. On the policy guidance it clearly says that if the main applicant has been granted visa for 12 and more months then the dependent can take full time employment.I’m kind of confused any advice will be greatly appreciated
    Regards
    Syed
I’m just wondering if this is a mistake?

    • Hi

Your application will be judged against the rules in place at the time of your application. This is defined as the date that the fee associated with the application is paid, as shown on your receipt.

The maintenance requirements for a family member of a Tier 4 (General) Student depends on the following circumstances:

      the length of the course;
where the main applicant will be studying in the United Kingdom; and
whether the main applicant already has an established presence studying in the United Kingdom.

How many months money does a family member of a Tier 4 (General) Student need

A family member of a Tier 4 (General) student must show that he/she has enough money to cover his/her monthly living costs whilst the student is studying in the United Kingdom.

The amount of money a family member has to show will depend on whether the student already has an established presence studying in the United Kingdom. Where a student has an established presence studying in the United Kingdom, the family member will need to show less money for living costs.

A student has an established presence studying in the United Kingdom if:

He/she has completed a course that was at least six months long within their last period of leave, and this leave finished within the last four months; or
He/she is applying for continued study on a course where he/she has studied at least six months of that course and has been studying within the last four months; or
He/she is applying to continue in Tier 4 as a Sabbatical Officer or as a Postgraduate Doctor or Dentist and he/she has completed a course that was at least six months long within his/her last period of leave, and this leave finished within the last four months.

A family member can qualify for the reduced maintenance levels whether he/she is applying from inside the United Kingdom or from overseas.

Where a student does not have an established presence studying in the United Kingdom, the family member must show that he/she has money for his/her living costs for each month of the students course up, to a maximum of 9 months.

A student with an established presence studying in the United Kingdom must show that he/she has money for his/her living costs for each month of his/her course up, to a maximum of 2 months.

The family member of a Tier 4 (General) Student where the student does not have an established presence in the United Kingdom

If the Tier 4 (General) Student is studying in inner London

The family member of a Tier 4 (General) Student who is studying in inner London must have £533 per month up to a maximum of 9 months, to support himself/herself.

If the Tier 4 (General) Student is studying in outer London or anywhere else in the United Kingdom

The family member of a Tier 4 (General) Student who is studying in outer London or anywhere else in the United Kingdom must have £400 per month up to a maximum of 9 months, to support himself/herself.

The family member of a Tier 4 (General) Student where the student does have an established presence in the United Kingdom

If the Tier 4 (General) Student is studying in inner London

The family member of a Tier 4 (General) Student who is studying in inner London must have 2 months maintenance of £533 per month, to support himself/herself.

If the Tier 4 (General) Student is studying in outer London or anywhere else in the United Kingdom

The family member of a Tier 4 (General) Student who is studying in outer London or anywhere else in the United Kingdom must have 2 months maintenance of £400 per month, to support himself/herself.
