Hello people, am looking for an advise on my APPEAL. I just received today, i sent my application on 29/06/2009 and i just received back today with an appeal. They refused me on the ground that my farther Bank statement that i provide is dated more than a month prior to my application date, also they said that i did not provide my birth certificate to show the relationship between me and my sponsor and therefore they unable to clarify that my sponsor is originally my farther.my farther Bank statement is last dated on 13 may 2009. and i made the application on 29/06/2009, they returned my application back to me on 08/07/2009, that i need to fill in my first visa number into the form i.e entry clearance number. i filled in and i send it back to them on 15/07/2009.den the now used 15/06/2009 as my application date is that right? I also include a Bank statement in my name aswel but is only show £1100 every month but as at that time they said we can use someone else bank statement if it our farther or mother to us that why i used my farther statement and they did’nt complain about me using it, but they said it more than one month to the date i sent the application. Now i want your advice if i have chance in winning the APPEAL or i should send a new application

i came to united kingdom on hsmp and have since renewed it for the next three years before i will apply for my indefinate leave to remain.my wife in nigeria have left for another man and my son with her who will be eighteen in may. have since her departure been leaving alone in my house in lagos. initially my grand mum was staying with him, but he passed away in may of 2010 ever since he have been leaving alone in the house.in december 2010, there are series of armed robbery incident in the house where the boy was attacked twice in the house by armed robber, hence this led me to take a decision of applying for a dependant visa for the boy which was refused, even concedering the fact that the boy have got her mother to swon to an affidafit releasing his right, which make me as the father to have a sole responsibility on him both finnancially and morally but the visa was still fefused based on sole responsibility what do you think i can do now that he has a right of appeal

If the UK Border Agency refuses your visa application and you think an error has been made, you can ask the UK Border Agency to check their decision. This is known as an administrative review. The administrative review is free of charge. You must ask for an administrative review within 28 days from the date you receive the refusal notice

I would also add that an AR will take several months. Many students prefer to submit a fresh application if there is an issue they can easily fix.

Dear Waslag,
It would be best to send in a new application, than make an appeal. It would be faster.
Also, your bank account has to be in your name, or if it is your parents’ account then it should be a joint account, your name still has to be on the account. The Embassy is also very very strict with the dates and the length of time the money has been in the account. The money has to be there for 28 days, and not more than a month.
I would always suggest a brand new account because it creates less problems than an existing one. When you open an account, count 28 days after. On the 29th day, get your certification from the bank, including the statement of account, the pass book and of course the certification which has to explicitly show the account number, the amount in the bank, the currency, the account name, and the date it was opened.
On the 30th day, you lodge your application at VFS. This is important because any delay would mean that your account will be over 30 days. And then you have start again.
The amount in the bank has to be enough, as required by UKBA. The figures am sure are on their website. If the money in your bank is not enough, your visa will be refused. The account also must not move, from the time you opened it, until you submit the documents to VFS. Any movement in your account is cause for refusal.
I hope this has helped you clarify things. The bank documents has caused me and my friends so much problems, and I have learned my lesson.
By the way, if you use a joint account with your parents, you need to include your Birth Certificate to show the relationship.
