Update on Suspended Colleges From Tier 4

Following our earlier post, UKBA Removes Institutions from the Tier 4 Sponsor Register, we can now provide our readers with an update on suspended colleges from Tier 4, covering some of the issues raised by our readers.

It appears that the UK Border Agency has unilaterally launched an exercise of review with over 50 colleges from the list of sponsors, which includes both big organisations and small colleges. It is likely that groups of colleges will continued to be audited by UK in this way in the future. The widespread view is that they will possibly suspend and inspect all colleges on the list eventually.

Suspension from the Home Office register of sponsors has come as a big surprise to many colleges. In fact, some tier 4 sponsors have never been inspected by the UK Border Agency since their original approval inspections in 2008 prior to tier 4 being launched and many schools and colleges have not been informed of any breach of UK Border Agency sponsor regulations.

The majority of schools and colleges who have been suspended from the UK Register of Sponsors have nothing to fear and are in fact confident they will be able to answer any queries raised by the UK Border Agency. The majority of licensed sponsors of education take great pride in their work and processes, often having stringent approval and tracking procedures in place. Many genuine equation providers on the sponsorship register whom we’ve spoken to welcome the chance to explain these procedures to the UK Border Agency Inspectors once again.

One issue to come out of schools and colleges having their sponsor licence suspended by the UK Border Agency, is the apparent lottery surrounding timescales for re-inclusion. There are several colleges who have been quite fortuitous and have been given early inspection appointments, sometimes as soon as 1 week after suspension from the Register. However, there are many schools and colleges who have not been so fortunate and have had to wait 3 – 6 weeks for an inspection and subsequent re-inclusion on the sponsor register list.

Many Colleges have gone through this procedure in recent months, and have had their Licence fully restored after satisfying the UK Border Agency inspection team.  Pending the outcome of the UK Border Agency’s enquiries, schools and colleges will continue with all of their activities in the normal way.

There is a lot of speculation surrounding what to do if you’ve already received your visa but the college or school has been suspended by the UK Border Agency before the student has travelled to the UK. Under the UK Border Agency regulations, students should be permitted to travel to the UK and begin their studies. However, we have heard from several students who have been refused entry to the UK at their port of entry, which is highly inconvenient and controversial. We recommend caution when considering travelling to the UK whilst your school or college is still under investigation by the UK Border Agency.

Another source of attrition is what should happen to students who have their visa application pending and find their school or college has been removed from the Register of Sponsors. According to UK Border Agency regulations, these applications should be put on hold by consular officials pending the outcome of the UK Border Agency Inspection Team’s findings. However, in some cases this has not happened and scores of students have had their visa refused for applying to a school or college which is not on the sponsor register. We hope that Entry Clearance Officers worldwide will be sufficiently briefed and re-trained to prevent this from happening in the future, although the author will not hold his breath!

If you have already applied and paid for your course and are awaiting your visa letter or Confirmation of Studies (from 22nd February) and your school or college is suspended by the UK Border Agency, you will have to wait until they are re-included before your school or college will provide you with the documents required for your visa application. Therefore please do not worry if you are in this situation – I suggest you remain in regular contact with your school or college to stay abreast of any change in circumstances and hopeful re-inclusion on the sponsor register.

The reason for this sudden spurt of activity from the UK Border Agency in this area is quite simple; the UK’s new immigration system and new Immigration Agency. The catalyst for many suspensions is the UK Press, frequently running ‘scare’ stories of ‘high numbers of bogus student and terrorists getting into the UK on student visas’ and the up-coming General Election, as the political party’s campaigns start.

If you are due to apply for a course of study in the UK then you should inspect more scrutiny from your school, college or education agent. You may find that your motive for studying in the UK may be more closely questioned and your documentation will certainly be more tightly scrutinised. Please don’t be frustrated by these checks and work with your education provider and/or agent to the best of your ability. And remember, if you are a genuine student coming to the UK then you should have nothing to fear.

      Goldsmith International Business School has been back on the Register for a while now, with an A rating.

      Where are you applying from? Because all applications from North India, Bangladesh and Nepal are currently on hold, so that may explain your delay.

    TASMAC is an A RATING COLLEGE by UKBA.

    But due to some reasons it as been suspended for temporary from tier4 sposer register.

    say ur sister do not worry about the college and it will be back soon.

    I have applied for Visa on 4th Jan 2010 and still i have not getting my Visa so i am worried about my Visa.My class will start on 22nd Feb 2010 that is my last day of my class.If my Visa will come after 22nd Feb 2010 does it be any problem.I am really worried about my Visa and my class.And my college name is Goldsmith International Business School.Is my college in Blacklist?Plz say me that also.

    Thank’s for giving such detail informaton about london school of business and computing……now wht is your advice to me as brother…..wht should i do in the next step…..will home office send me any letter …..about the license of the college and give me deadline for change of college……and second thing is that…..if their license is supended …..then y they not open the college…..because as rules of home office if college license is suspended then they can continue their normal work…..and as u give me some information about the college overseas agent problem….i have checked london school of business and computing website ….i have not found any information about this……sorry for such a long messege ……but brother i m in deep hot water…..wait for u kind replay……thank’s …..

    • hi every one ..im student in the london school of bussiness and computing from 17of setember …i aplied for mi visa on the 30 of november and i went to to my fingers prints and picts for the id 8 weeks ago and i still didnt get it …no even news from the school as it closes and no one answer the phone ..what should i do … pay and other school and send it to the h office or what …i dont really know what to do?

      i saw your comment. my sis has also applied for MBA which was to be commenced from feb 8. we were very tensed, bcoz we didnt knew when will the college will be expected to come back in the list. so can we really expect that TASMAC will be back again on the tier 4 sponsors list??

      it will be a great news for all of us. coz my sis application is on hold.

      • hey aisha well u knw i’ve applied in UKHELP4U college on 11 feb but unfortunately my college also delisted so i heard that this college not easily becoming in list coz the border agency gave them a warned letter since 6months before, that is i’ve given withdrawl letter n now getting admission in LCCMS college let see what will happen please do offer praying 4me all of u guys..

    let me know that did u receive the vias, and if u recieve the visa u need to wait till the updation of the college in UKBA WEBSITE.

    I AM ALSO THE STUDENT OF TASMAC LONDON SCHOOL OF BUSINESS,WAITING FOR THE COLLEGE UPDATION IN THE UKBA WEBSITE

    FOR UR KIND INFORMATION OUR COLLEGE AS POSTPONED THE COMMENCMENT CLASS TILL 15 FEB 2010. SO THE COLLEGE WILL OPEN ON 15 FEB 2010.

    LAST FRIDAY THE UKBA AS BEEN CALLED TASMAC FOR THE INSPECTION. AND MOST PROBABLY WE CAN EXPECT OUR COLLEGE IN THE UK SPONSER REGISTER LICENCE FOR TIER4 SOON INTHIS WEEK.

      Your application should just be placed on hold while the suspension is resolved. In some cases, students have had their application refused, but this is definitely the minority.

      You should contact your college to discuss the situation – surely they have provisions for starting the course late?

      London School of Business and Computing has had problems with overseas agents; apparently some illegal agents have been making fake documents with the college’s logo and information, for students to get permission to enter the UK.

      As you’ve already got your visa extension, you shouldn’t have too much to worry about. Even if their sponsor licence is withdrawn permanently, you will be given time to change education provider.

      Here’s some details from their site:

      Student Notice
      We are informing to all international prospective students that few fraud agents overseas and local are issuing fake documents with our college name to prospective students to get Entry Clearance Visa, we have noticed that some unconnected people of the college are issuing fake documents; they will be put into Criminal action in home country.

      Due to some frauds issuing forgery documents in our college name has been caught and students have been charged large amount of money in college name in overseas. It is for this reason, college has created the database system to protect each and every student from being cheated and defrauded.

      Therefore please verify your details with our college online database before going to British High Commission / UK Border Agency for your visa, students’ enrolment must be verified with his/her reference number by directly on this website to confirm the authentication of the document issued to each student. All employment Verifications can be made directly under this section of the website.

      Do let me know how you get on – what are your thoughts of the college, do you like studying there?

      Hi and thanks for your comments.

      As of 8 February 2010, London SAM still does not appear on the Tier 4 Register of Sponsors. They have released the following statement on their website:

      LondonSAM wishes to make the following announcement:

      LondonSAM’s Tier 4 Sponsorship Licence has been put on hold by UKBA. The College is continuing with its normal activities from guidance given by UKBA; it will carry on with its obligations as a Sponsor. There will not be any interruptions to any lectures.

      We are awaiting further clarification from UKBA. As soon as we have determined the reason, we will address the situation as soon as possible. Meanwhile, please note:

      1. Those who are enrolled with us at the moment will continue with their studies as normal.
      2. Students NOT attending lectures in accordance with their timetable will be reported to UKBA.
      3. For those students who have been granted visas and are on their way to study, the College will fulfil its obligations.
      4. Until clear guidance from UKBA is given, we will not be issuing any further visa letters.
      5. We will update this web site as soon as there is further development.

          The college is still suspended and your application will be placed on hold until the suspension is resolved.

          The school’s website has a lot of notifications about new systems the UKBA have asked them to implement.

          Have you spoken to your college about this – what are they saying? Have you heard from the Home Office at all?

              • Hi Syed

                Try not to worry too much – if the college’s licence had been permanently withdrawn, the UKBA would have informed you, as you currently have an application pending.

                If this happens, you will be given time to apply to a new education provider, up to a maximum of 6 months.

                So, you should wait until the UKBA contact you regarding your extension. Your current college should not stop you from starting your new course if you studied their previously, just because you have an extension application pending.

    • Hi Raza

      You don’t need to change college to extend your student visa just becuase your education provider’s sponsor licence has been suspended. If you apply to extend your visa during the suspension, your application will be kept on hold by the UK Border Agency until the suspension is resolved.

      You can change college if you want to, but you will probably not get any refund from your current college. Renewing your student visa from inside the UK depends on when you were granted your original student visa: before or after 5 October 2009.

      If you got your tier 4 student visa before 5 October 2009

      You will have to obtain permission from the UK Border Agency to change education provider. You can ask for this permission by sending an email to MigrantReporting@ukba.gsi.gov.uk. You must include the following details:

      - the new sponsor’s name, address and contact details; and
      - details of the new course, including the start and end date; and
      - if the new course is shorter or longer than your current course

      The UK Border Agency will write to you confirming they’ve received your request. As long as they can confirm the following information, you will be given permission to change tier 4 sponsors:

      - your new education provider is currently licenced under the Tier 4 Register of Sponsors; and
      - your new school has accepted you and wants to be your new sponsor; and
      - your new planned course of study meets the necessary requirements to qualify under the Points Based System

      Once you have emailed the UK Border Agency with the above information and have received an acknowledgment from them you can actually start your new course without waiting for the result of your request.

      However, this is at your own risk as the UK Border Agency may well decide to refuse you permission to switch sponsors.

      If you fail to ask the UK Border Agency for their permission to switch sponsors you’re permission to stay in the United Kingdom as a student will be limited.

      If you got your tier 4 student visa after 5 October 2009

      It is much simpler to change education provider in this situation. You just have to make a new Tier 4 (General) Student visa application supported with a new visa letter of confirmation of acceptance for studies from your new tier 4 sponsor.

      You will not be able to start your new course until your new visa application is approved by the UK Border Agency. You are free to leave your current sponsor but do so entirely at your own risk, as the UKBA may refuse your application meaning you may not be able to return to your original course.

    “TASMAC LONDON SCHOOL OF BUSINESS” is an registred sponsered licenced from the UKBA…. If suspended, for how many days may it takes to come back in Tier 4 registred Sponsor licence…

      As of 8 February 2010 Tasmac London School of Business does not appear on the Tier 4 Register of Sponsors so it suggests they have been suspended.

      As long as the college hasn’t done anything naughty, it should take anywhere from 3-6 weeks or several months for them to be inspected and have their suspension lifted.

      Your visa application will be placed on hold until your education provider’s suspension is resolved. You should stay in regular contact with your college to get updates as to how the inspection went and when they think they will be re-included on the Register.

      I will contact them now to ask for a press release. I will post anything I receive in reply here.

      • hi my sister was also about to start her class from yesterday i.e 8 feb. at tasmac london school of business. she had extention till 22 feb….now what should we do, she already applied for her visa on 4 th january, now what will happen to her application.. can she ask for more extention…how many days it may take to resolve the issue..??

          A B rated college has at most 12 months to get an A rating back again or their sponsor licence will be permanently withdrawn.

          You can change college at anytime. When were you granted your original student visa – before or after 5 October 2009?

    i applied to New London College and it has been suspended recently from sponsorship.I applied 8th of Desember. and last date of joining my class is on 01st of February 2010. now my visa’s file is on hold/under process as such I am getting worried about my visa. college said this problem will solve within 2 or 3 weeks.. but now 5 weeks passed… please sir, please tell me is my college will come back to the list again?????

      As of 8 February 2010 New London College does not appear on the Tier 4 Sponsors Register. It has clearly been suspended and I do not know when it will be re-included on the Register. We’ve found it’s taking anywhere from 3-6 weeks to several months for education providers to have their suspension resolved.

      You should stay in regular contact with your college and make sure you defer the start date of your course. Is your college being reasonable?

      I have contact New London College for a press release surrounding this issue and will post anything I get back from them here.

      I believe everybody knows the current situation regarding the suspensions. There is nothing much we can comment about it until we know what the UKBA exactly wants to do.

      Initially the submission was due to the non submission or the BAC Inspection Report for our new campus to the UKBA, but when the BAC has submitted it to them immediately, they have been asking for additional information whenever their deadline of 14/28 days approaches, and delaying the decision on reinstatement. We believe it is more to do with the clarity about policy rather than the colleges not playing the game rightly.

      To blame the colleges for illegal immigrants is nonsence, as most of the terrorists or illegal immigrants have used the safer routes of Universities, rather than colleges. We have hardly seen any ‘No Show’ students (may be 2 out of 1000). All our students are genuine and are serious about their studies and are attending classes. We have one of the best facilities in the private sector, for which even our students would vouch for.

      The UKBA should have foreseen high volumes before they could implement the PBS, but they have failed in implementing the policy in the right way.

    My wife is going to enroll at London School of Commerce to do her MBA, since i heard that many colleges have been take off from the tier 4 list this makes me bit worried. LSC is A rated but do you have any idea if they are strong establishment in terms of education?

      Thanks for your comments and I think you’ve raised a good point.

      However, the UK Border Agency’s inspection policy seems to be non-discriminatory and far-reaching: all schools and colleges, big and small, are being suspended and investigate by the UKBA.

      I have no personal experience of the London School of Commerce, so can’t comment on it. But, it has an A-rating and is approved to sponsor student migrants, so I wouldn’t be too worried. Even if the college is suspended and inspected once your wife is studying, she still won’t experience any problems. As long as the college does not have their licence withdrawn permanently – which will only happen if they grossly break the rules – then your wife’s studies should be fine.

    Yes, sir it is already quite a long time.I used an agent to enroll in their college and they are the one helping me now to pursue this because they are also victim of the school.I know they have done their best because they have been writing to the school countless times through their lawyer here in the Philippines but it was ignored by the school.They stopped giving us update .The school is not responding now, to me and to my agent. Yes, I was aware that the GBP 500 is non -refundable but the school promised me that they will issue a visa letter three times If I wil be refused.But that is futile now because the school cannot issue a visa letter because they are suspended!

    It would be okay with me if I was refused because there was problem with my documents but to be refused because of the school’s shortcoming is I guess another thing.They should also be flexible in this case because they are the reason why I cannot move on.

    I would be willing to pursue this case because I’m not alone here, there are also many students whom I know who was enrolled in that school who suffered what I have suffered now.I hope I can find a good legal counsel who can help me pursue this case.

      The college’s website shows that they are not accepting any new enrolments now and they are still suspended.

      Have you / your agent / lawyer managed to get any further updates from the college?

        We have been trying to contact the school thru mail and email but to no avail they are not replying to our emails and nobody is answering their phone.

        Sir, can you advise me on what step should i do next?Is it possible to hire a lawyer who can help me who is based in London?I have so many friends here who are also enrolled in that school and we are willing to pursue this case, should there be somebody to represent us in UK.

      i m a student of alpha meridian college and it has been suspended recently from sponsorship. i m trying to change my college but i cannot find the college which suits my criteria in education field. i m in deliema shall i wait until the final inspection decision or change my college ASAP.if i wait and unfortunately my college gets suspended permanently then by the time i would to be to late to get admission in other college coz it will be fully packed or registration date will be out of time. what should i do please give me an appropriate suggestion regarding this matter. would be highly appreciated.

    I am currently studying in London Sam ad it is on hold by ukba at the moment. I just wanted to know coz my visa will expire in april so should I wait till they get their license back or should i change college?

      You can still renew your visa, but your application will be put on hold until the suspension is resolved.

      London SAM released the following statement on their website:

      LondonSAM wishes to make the following announcement:

      LondonSAM’s Tier 4 Sponsorship Licence has been put on hold by UKBA. The College is continuing with its normal activities from guidance given by UKBA; it will carry on with its obligations as a Sponsor. There will not be any interruptions to any lectures.

      We are awaiting further clarification from UKBA. As soon as we have determined the reason, we will address the situation as soon as possible. Meanwhile, please note:

      1. Those who are enrolled with us at the moment will continue with their studies as normal.
      2. Students NOT attending lectures in accordance with their timetable will be reported to UKBA.
      3. For those students who have been granted visas and are on their way to study, the College will fulfil its obligations.
      4. Until clear guidance from UKBA is given, we will not be issuing any further visa letters.
      5. We will update this web site as soon as there is further development.

    UKBA has not contacted with me yet & suspension over Holborn College has been withdrawn. Holborn College informed me. I will be flying to UK on the 11th of this month. Thanks alot for your co-operation…Pray for me and stay cool……It was nice meeting you….Take care…Bye….

      Holborn College’s suspension was lifted on 5 February 2010, so hopefully you’re already in the UK!

      Under what circumstances? Are you affected by the temporary hold an all visa applications from Northern India, Nepal and Bangladesh? If so, apparantly the situation is being ongoingly reviewed and an announcement is expected at the end of February. As soon as we hear anything, we’ll let everyone know, right here.

      If you are affected by the hold placed on applications following suspension of your sponsor’s licence then you will have to wait until the situation is resolved and the UK Border Agency’s concerns have been dealt with. This can take anywhere from 3-6 weeks to several months.

      Is you let me know some further details about your questions I could give a more in-depth answer.

      Are you sure your college is Goldsmith International Business College and not Goldsmith International Business School?

      Goldsmith International Business School appears on the Tier 4 Register of Sponsors, as of 4 February 2010.
