The UK Border Agency (UKBA) has recently revised the tier 4 sponsor register and has removed several institutions from the list. UKBA announced on the 25th August that all applicants should ensure that the institution they are applying to is on the tier 4 Sponsor Register when they apply for a UK student visa. You should check before submitting your application that your chosen institutions have not been suspended or withdrawn from the list. If your chosen institution is not on the list, the embassy will not be able to grant you a student visa. If you have a visa letter that you got before your approved education provider’s licence was suspended, and you have already been granted permission to enter the United Kingdom, but you have not yet traveled, you are advised not to travel until your educational institution’s status has been resolved.

There have also been some great and helpful replies from other readers too which is fantastic!
When a college is suspended from the sponsors register it will be reviewed and inspected by the UK Border Agency. In many cases the UKBA have told the school or college what improvements they must make (an Action Plan) – and they will re-appear on the Register, often with a reduced B-rating. This can take anywhere from 3-6 weeks to several months. Several colleges have had their tier 4 sponsor licence withdrawn permanently, often becuase they broke the tier 4 rules or ran their business badly.

As of 2nd February 2010, Tasmac London does not appear on the the Tier 4 Register of Sponsors.

In TASMAC’s case, it has taken 55 days for the issue to be resolved. TASMAC UK Ltd. Tier 4 Licence suspension lifted 17 March 2010. It has been re-included on the Register with a B-rating.

We are finding that it is taking anywhere from 3-6 weeks to several months for schools and colleges to resolve issues raised by the UK Border Agency.
As your college had its licence suspended after you’d submitted your application, the embassy should keep it on hold, only deciding once the suspension has been lifted.

You’d be waisting your time to submit your application it will be refused. Your college currently has no sponsor licence so any new applications will be refused.
As you have already paid for the place at your college you may well not be able to get a refund to change college yet. Check your terms & conditions but you probably need a visa refusal document to get a refund.
You will probably have to wait until the suspension is lifted. Could take 3-6 weeks or several months.

You should be OK as according to the rules set out by UKBA, your application should be put on hold until the suspension is lifted.
However, there have been many examples of students who have actually had their application refused as their school or college was not on the Register of Sponsors.
Regarding your idea to get a refund, I don’t think you’ll have much joy there. VFS won’t care and I don’t think your school or college will refund you, as applications should be placed on hold. I imagine in this case you’d have to apply for an administrative review, but this can take ages. You must apply within 28 days of your refusal. Remember, any right of appeal was removed then the Points Based System was introduced.

thanks for your help. actually submitted my docs yesterday. Ill tell you if I was refused. I know that VFS will no longer give me back my money. My school shall i think return 70 % of my money. This is it if not then goodbye british embassy. This is already my third application aready. Ive had it, all the stress it gave me.

If you submitted your application before your college was removed from the Tier 4 Register of Sponsors then it will be placed on hold until the suspension is lifted. You will simply have to wait to hear the outcome of your application. This could take 3-6 weeks or several months.
You said your course was due to start on 15 January 2010. Have you contacted your college to defer your start date?

Hi i just want to ask, i’d been here in uk for 2 years studying nvq course. the problem was, when i came here my school is a bogus instiution i’ve tried contacting them but they keep promising im going to start my class soon, but it never happened.i paid 1500 for the whole year course and im so disappointed .my friend advised me to take nvq course in north somerset council i paid less and luckily i got my nvq3 health and social care certificate from city and guild just last month,since there are some changes implemented by home office’that all international student must be enrolled under PBS tier4 so i enrolled to another school again that is listed under tier 4 system and now id been currently studying A1 Assessors award.im going to renew my visa this feb because my visa will expire on march 31 2010 to continue my existing course,the problem is i didnt inform the home office about changes of my school.im a bit worried hence this might affect my application.i need advice, thank you and godbless.

Given the nature of your comment I suggest you speak with a fully qualified and ragulated immigration lawyer. You can find the nearest ones to you through the OISC.

Can you please give me the full name of the college?
If your college really has has their sponsor licence permanently withdrawn, your permission to stay in the UK will be limited as follows:
- 6 months if you had nothing to do with the withdrawal, during which time you can apply at another college; or
- immediately, if you are involved in the reason your college’s licence was suspended.
You should check the college’s terms & conditions to find out exactly where you stand regarding a refund, but I’d be surprised if they wouldn’t give you one and you may well have a solid case to sue them. You should of course, discuss any details of doing so with a fully qualified and regulated litigation specialist.
You should also consider insurance against any loss of tuition fees and travel costs. Find out further details through the banner below:

Thanks for your comments. I’ll answer them using the same numbering:
1) If a college has its Tier 4 licence suspended, it will be inspected by the UK Border Agency. It can take a long time for a school or college to make an appointment to be inspected. The time needed to fix any concerns the UKBA have could be anything, depending on the extra checks, systems and processes that the college may now have to implement following inspection.
2) For all applications where the college lost their licence whilst the application was pending, they should be put on hold until the UKBA’s concerns are resolved. Any new UK Student Visa applications made whilst the college is suspended will be rejected.
3) No such list of colleges which have been removed from the Tier 4 Register of Sponsors exists. You should continue to monitor the sponsor register. We maintain all historical copies of the list allowing you to compare them over time. View the Tier 4 Sponsors Register

if my college was in list before i applied (15 jan i applied on) the college was on list (oxbridge college of it & management) which was B- rated college,
its removed from list on 27 of jan 2010.
I have applied from hyderabad, india. (south)
as i read in rules there is no problem with south students, but due to college suspended i need to wait.
in recent post u said “Sometimes a Civil Penalty is OK”
what if my college was B- rated?
if they pay penalty will it comeback as it was B= rated?

Thanks for the update and new information.
The fact that your college was B-rated before it was suspended does lead me to believe that it is likely the college’s licence has been withdrawn permanently. From what I understand of the UK Border Agency guideliens surrounding this, if you are unable to improve your operating procedures and achieve an A grade again within 12 months, then a sponsor’s licence will be withdrawn permanently. But we must remember that if a sponsor’s licence is withdrawn permanently, the UK Border Agency should contact you personally to explain the situation.
You are correct Habib; visa applications have not bee suspended for South Indian students, to the best of my knowledge. You’re application is therefore pending becuase your sponsor’s licence has been suspended.
Have you been able to speak to the college or your agent about this?
I’ve have emailed them asking for a press release about this matter and will post anything I receive from them.

Well Holbron college is of Kaplan colleges and was supposed to be one of the good colleges, but as you can see the college is suspended now and it is unlikely that their suspension will be lifted soon. Holborn college will definatly be back on the list but they have some long process to be completed. You can check on the list of the registerd sponsors and then apply to the colleges that are in the list. its better if you join a university.

As the many colleges are in the suspended list now, it is hard to tell when they will be back in the list of UKBA register sponsors. Well what i can suggest to you is that, as you have already applied for the visa and i suppose it was before the college suspension. In this case you will hear from the high commission when the case of college is fully resolved, till then your document process will be halted.
