UKBA Removes Institutions from the Tier 4 Sponsor Register

The UK Border Agency (UKBA) has recently revised the tier 4 sponsor register and has removed several institutions from the list. UKBA announced on the 25th August that all applicants should ensure that the institution they are applying to is on the tier 4 Sponsor Register when they apply for a UK student visa. You should check before submitting your application that your chosen institutions have not been suspended or withdrawn from the list. If your chosen institution is not on the list, the embassy will not be able to grant you a student visa.  If you have a visa letter that you got before your approved education provider’s licence was suspended, and you have already been granted permission to enter the United Kingdom, but you have not yet traveled, you are advised not to travel until your educational institution’s status has been resolved.

      Unfortunately there is no such list! All you can do is monitor the Tier 4 Register of Sponsors to see if and when the college appears on the list again.

      It would be great if such a list did in fact exist.

  • Hi Sir,

    I would like to ask you a quick query. Recently i have got the UK student visa on London school of Business and computing under Tier 4 scheme. After gettin my visa, I have booked my flights to visit Uk on Sunday and got the news yesterdat that my college is now removed from the UKBA student licence sponser? I have tried to call them but they are not giving me good valid reasons. I’m worried to travel now. Can you please advise whether I can travel on the planned date or shall i withdrawn from the course. Kindly note that i have paid the tuition fees of 2000£.

    I would appreciate your expert advice on this matter.

      I should say in the first instance that I can’t give you expert immigration advice; for that you should consult an immigration lawyer.

      Many schools and colleges are being investigated by the UK Border Agency. I’m sure this is part of the overall change to the UK immigration system and the regular inspection of colleges will become the norm, presumably to clamp down on bogus colleges and students. So your college’s sponsor licence may have been suspended pending investigation. In itself this is nothing to worry about as many colleges, both big and small, have already been inspected. It takes 3-6 weeks for a college to learn the outcome of the investigation.

      According to the UK Border Agency, if you’ve received your visa letter before your college’s tier 4 sponsor license was suspended and have already been granted a UK student visa you are advised not to travel, but to stay in your country until the suspension has been lifted. The UKBA go on to state that they will try to contact you once their investigation is complete, and you should not come to the UK until they’ve done so.

      Have you checked whether your college is back on the Register of Sponsors yet? You can find the daily updated Register here: Tier 4 Sponsors Register.

      How long is it until your booked flights leave? Do you have more than the 6 weeks it may take the college to have their suspension lifted? You should also speak with your travel agent or airline and see if you can change the date of your flight. Most carriers will allow you to amend the ticket for a fee, but it does depend on the terms and conditions. Cheaper and deal tickets may often not allow any change.

      With regards to withdrawing from the course, you may not be able to do that either as you have been granted a visa for the course, so may not qualify for a refund. Again, check your terms and conditions and speak to your college. I’m sure given the circumstances they will just postpone the start date of your course.

    Sir, I have got a visa letter from St. Patrick’s International College, London. I have not yet submitted my visa application at any center here in Bangladesh.

    I have heard a moment ago that my college don’t exist in the UKBA licensed college list.

    I am willing very much to start my postgraduate study from January,2010 session.

    What will happen to me? How I can get back my tuition fees, I have provided to that college? How I can hurry to proceed for a new college? How much money I have to loose for this disturbance? Why do these colleges are loosing their license or becoming black listed? Why these are suffering to the pupils; hoping to go there for study, making a bright future?

    These all are causing a great anxieties for the students like me along with the families.

    How these problems could be solved without any harm to the long cherishing will of the students’ to go there in London for study and making a different successful life.

    I am passing my days in a great depression. I wanna go to London without any delay. Allah, please make all situations just like the way, so that every thing would be supportive for me.

      Thank you for your comments and for sharing your experiences. Don’t despair too much as the situation is perhaps not as bad as it may first appear.

      You are right, St. Patrick’s International College does not currently appear on the Tier 4 Register of Sponsors. Have you spoken to the college to find out from them what is happening? It is most likely that their sponsor license has been suspended pending investigation. The investigations made by the UK Border Agency have included all schools and colleges, big and small and is most probably routine. It will take anywhere from 3-6 weeks for your college to know the outcome of the investigation.

      If you don’t want to wait that long and would like to change college then you need to read their terms & conditions. As you’ve already paid for your course, you accepted their offer of a place to study and the only route to a refund would be a visa refusal. This is normal for most schools and colleges in the UK.

      As you haven’t yet applied for your visa and your college has been removed from the register, you are in a rather awkward position. If you submit your application it will be refused as the school does not have a valid sponsor license. Therefore your only course of action may well be to wait.

      If I were you I’d speak to the college themselves and ask what your options are, but they may very well act as outlined above. Just defer the start of your course, stay in regular contact with your college and await the outcome of the UK Border Agency investigation.

      Notice to all staff and students at St-Patrick’s College

      1. Some of you may be aware that St Patrick’s College UK Border Agency (UKBA) Sponsorship Licence has been temporarily suspended with effect from 18 January. Do not be alarmed. This is not a measure aimed at St Patrick’s College alone. About 60 Colleges have received similar notification. The UKBA seems to have a general query affecting the private college sector as a whole, and a response is therefore being co-ordinated at sector level by inter alia the British Accreditation Council (BAC), UK Council for International Student Affairs (UKCISA), and Study UK.

      2. We believe that most of the UKBA ‘s questions relate to student attendance figures. It is normal procedure in such cases to suspend a College Licence for a short period whilst UKBA clarify the position. Many Colleges have gone through this procedure in the past, and many have had their Licence fully restored once the clarification has been received.

      3. Our Licence has been temporarily suspended until the UKBA has the opportunity to visit the College and satisfy themselves that our procedures comply with their requirements. We expect their visit to take place quite soon. I am confident that we will be able to answer all of the UKBA’s questions satisfactorily and that our Licence will be restored in due course. The College will of course collaborate fully with the UKBA team, and I welcome the chance to explain to them that our own procedures not only comply with, but in fact exceed, the stringent requirements which they set.

      4. Meanwhile, I wish to emphasise that pending the outcome of the investigation, the College is continuing with all of its activities in the normal way. Our induction programme has taken place as planned, our teaching programme for the new term will commence on 25 January, and the refurbishment of the new premises at Sheraton Street is on schedule.

      5. I wish you all a successful new term, and will keep you informed of developments. You, our students, can help the College by continuing to fulfil all the UKBA’s requirements. Please ensure that you attend all your classes on time, submit your assignments on time, and do not breach the terms of your student visa. It is vital that both the College and the students give the UKBA no reason to doubt our, or your, integrity. A student visa is granted to enable you to study. Please remember that and act accordingly.

  • I have applied for my visa a month ago and have heard nothing from them. Today i get a letter from my college saying that the sponsorship has been temporarily suspended from UKBA list. I am extremely stressed, don\’t know what can be done. Its is allright if High commission puts my visa on hold but what if they refuse it? Is there anything that can be done.

      You’re right in thinking the High Commission can put your application on hold, so don’t stress too much!

      The Tier 4 regulations do state that a student’s application should be placed on hold if the school or college has their sponsors license temporarily suspended pending investigation. However, there have been some occasions where students have had their application refused as their school or college no longer appears on the Tier 4 Register.

      You’re best course of action is to wait and see the result of your application. In fact, you won’t be able to do anything such as get a refund or book your plane ticket until you know the outcome and have the necessary documents. In any case, the UK Border Agency Inspection Team are taking 3-6 weeks to inspect and report their findings, so you should know the outcome of your student visa application around the same time.

  • What if the education providers license is suspended after the student has sent his passport to the home office for visa extension?

      You can still apply to extend your permission to stay if it runs out when your approved education provider’s licence is suspended, as long as you already have your visa letter. However, your application will be on hold until the suspension is resolved. So you won’t have your passport back until the issue is resolved.

      If the UK Border Agency Investigation Team decides that your school or college should no longer be included on the Tier 4 Register of Sponsors and therefore revoke their sponsors licence, your permission to stay in the UK will be limited in the following way:

      - to 60 days if you were not involved in the reasons why your approved education provider had their licence withdrawn (we will not limit your permission to stay if you have less than six months left. You may want to apply for permission to stay with another approved education provider during this time);

      - immediately if we think you were involved in the reasons why your sponsor’s licence was withdrawn.

  • I have applied for the student visa in 25th nov.2009 and after my visa expires on 30th nov.2009, after 1 and half month my visa file came back becoz of my photos are too small, than

      It is true that Anglian College no longer appears on the UKBA Tier 4 Register of Sponsors. At this point in time, it is most likely just a suspension and not a complete removal from the Register. You shouldn’t experience any problems unless your visa is about to expire. If you give me some more details I can help you further.

      As you’re only just begun your studies, your college’s suspension from the tier 4 Register of Sponsors shouldn’t impact you at all. To find out exactly why your college has been removed from the UKBA register you’d need to speak direct with your college, but they may not tell you. You could read an Update on Suspended Colleges From Tier 4 for a general discussion surrounding UKBA suspensions and inspections of colleges. Your colleges suspension shouldn’t impact the validity of any certificate you receive.

      Unfortunately there is no list of just suspended or blacklisted colleges. The only list that exists is the UK Border Agency’s official Register of Sponsors (Tier 4). We’re working on an application that will let you track the status of any school or college as it is suspended and re-included on the list. We’ll post here when it’s available.

    Hope that u r well. I expect to God for u that.
    I submitted my application form to VFS @ middle September. I took offer/visa letter from A A HAMILTON COLLEGE of LONDON which was “A” rating college. A few days ago British Embassy asked me for the Late acceptance letter from same college.
    I did collect it from the college.But College is Suspended/black listed.(I don’t know correctly, Suspended/ black listed?)

    Could You advise me please, What can I do ? I should submit the Acceptance letter or Not ? If I Submit, Have any problem here ?

      It is most likely that your college has been suspended from the tier 4 register of sponsors, pending investigation and inspection by the UK Border Agency. You can read more about this here: Update on Suspended Colleges From Tier 4. As your college had its license suspended after you had submitted for tier 4 (general) student visa application, it should be put on hold until the UKBA Inspection Team reports its findings.

      As VFS have asked you for extra documents, I would provide them. You have no reason not to, that I can see. Do you know why you’ve been asked to provide a Late Acceptance Letter?

      I’m slightly confused by your comment, but I assume that you’re currently in the UK as you’ve submitted your passport to the Home Office for a UK student visa extension. Is this correct?

      If your college was removed form the tier 4 sponsors register whilst your extension application was submitted, then according to the UKBA your application will be on hold until the suspension is resolved.

  • i have applied for my visa and i got my visa letter from east bank college..now i find that it got its license suspended.so it will be a very hard task for me to enter uk even if i get the visa.can any one say me how many days or months it takes to get this suspension cleared by any college.i am really worried.i hope this thing will not affect my visa decisions

      I’ve replied to your comments in a funny order so forgive me lol. Let me now answer your original point.

      Finding out that your college has been removed from the UKBA Sponsors Register after you’ve submitted your visa application is quite a common occurrence. And a perfectly legitimate and respectable college or school can be removed / suspended from the tier 4 register at any time it seems. We’ve spoken with several schools who have been removed from the register and they have reported an average time of 3 – 6 weeks before they have satisfied the UK Border Agency and are returned to the UKBA sponsor register.

      Unfortunately, it’s not a simple case of delaying the start date of your course and waiting for the college to address the issues raised. We’ve spoken with several students who’ve had their visa application refused as their sponsoring college doesn’t appear on the register. This I think is utterly ridiculous. What also compounds the problem are the terms and conditions of most colleges; a refund is usually only possible upon producing original UK student visa refusal documents. So if you wanted to simply cancel your enrollment and apply elsewhere, you’d need the extra cash available to pay for a new course.

        i’ve a same problem. When i applied for VISA, my college was clear of the list. and not its on the list. i dont know what my VISA result will be. I’ve applied on 5th Jan, and my college is in the blacklis (20th jan). I dont think i will get the visa, but i was worrying about the refusal reason… what if my VISA is refused and my college get their licence back and the reson for refusal is “your college is not in a list of TIER-4″

          Have you heard anything yet about your application?

          They really shouldn’t reject your application on this basis and lets hope they don’t. If they do you and then your college gets their licence back, you could of course just re-apply for a student visa.

          If you’re adamant you want to change colleges, then you should be able to get a refund as you have an official, valid visa refusal document, so don’t worry too much.

            Thanx for your concern….i havent got any decision yet…my college people say they will get the notice within 14 of feb…and dey said they are doing there best to get them self back…i understand too what they are going through…actually i just feel bad for my self…god knows why i applied in Uk… just becoz of the fact that i dint hav to show huge bank solvancy and the source of money i got into this idiotic rush … i feel sorry for my self…my ielts validity is also getting over..i had a satisfactory score of 6.5..i dnt think of the tution fee dat i had submitted coz ..it was really preety less…there is some one close in that college who works in the administration of that college…so i had a huge discount on my tuition fee … but i am annoyed becoz i have wasted a huge tym.. now i fel even if i get the visa i shouldnt go there…i feel so disgusting about the UKBA people… And to add up to the trobl they have stopped the application to bangladehi ..nepali and north indian VFS …dammm this ukba is going crazy i feel/… wat ever u let us know if i find any details

  • Hey, today I had my appointment at the British Embassy here in Bogotá. After they went troughout my application, they informed me that Edgware Academy no longer appears on the UKBA Register of Sponsors since yesterday, 19th January. However they accepted my appplication with Edgware’s Visa Letter. They told me they were going to study all the documents I provided and, once Edgware is granted again as an official sponsor, they will send me an email in which they inform if I’ve got the Visa or not. Right now I’m worried about that and I really need to know how long does it take to get the official approval back again. I called Edgawares but they couldn’t give me a factual answer.

      According to the guidelines set out under tier 4 of the UK Border Agency’s Points Based System, consular officials are meant to put your application on hold if a school or college gets removed from the tier 4 register of sponsors while your application is pending. However, we know of occasions when students have had their tier 4 general student visa application refused because their school of college no longer appears on the sponsor register. This has, however, happened in the minority of cases and we could find no explanation as to why. The students concerned had to re-apply for their visa once their college was back on the tier 4 register.

      In our experience, it has taken schools and colleges 3 – 6 weeks to satisfy the UK Border Agency’s concerns and be re-included on the register of sponsors. You could try calling the school again to get further details on why they were removed from the register, but I they may well not tell you. If you’re sure you’ll score 40 points for your tier 4 (general) student visa application and you can delay the start date of your course, then you could just relax and wait the time. We can keep an eye on the register of sponsors for you and let you know when the school is appears again. Be sure also to stay in contact with the school, get regular updates from them and defer the start of your course.

      We are also from Bogota applying with Edgware Academy and experienced a similar problem to the one you describe above. At the moment, we do not have clarity when, and if, the school will return to the register of sponsors. So please get in touch if you learn anything on that topic.

      Currently, a list of colleges which have been removed from the tier 4 register of sponsors – ‘blacklisted’ colleges – does not exist. You would have to check the sponsors register to see if the name of your school or college appears. We can check for you, post the name of the school.

      We’re working on creating such a list at the moment, which will allow you to monitor a school or college’s sponsors register status.

          According to the UKBA, you can still apply to extend your permission to stay if it runs out when your approved education provider’s licence is suspended, as long as you already have your visa letter. However, your application will be on hold until the suspension is resolved.

          Now this is what the rules are supposed to be but as we’ve all discovered, it doesn’t necessarily work like that. Before we discuss any other options available to you, perhaps you could tell me if you already have all the necessary documents from your college before they were removed from the tier register of sponsors?

      I’m afraid to say you’re correct; as of today (19 January 2010) Holborn College no longer appears on the UKBA Register of Sponsors. If you need to renew your visa before they appear back on the list you will run into problems. If we can be of any help, come back and post and we’ll do our very best to help you.

          If you are talking about Crown International College London in Thornton Heath, then as of 29 January 2010 it is included on the Tier 4 Register of Sponsors and has an A rating.

      • Unfortunately there is no way to know if a school or college has been permanently removed form the Register. If a school looses their license your any application will be refused and any visa canceled, meaning if you haven’t already traveled you will not be able to do so as you no longer have entry clearance for the UK.

        You will have to keep checking the Register to see if they come back and of course, speak with the school and find out direct what is going on.

      As of 29 January 2010, Tudor College London does not appear on the Tier 4 Sponsor Register. According to a previous commenter, Tudor College’s sponsor licence was suspended as far back as November 2009 and the UK Border Agency’s issue have clearly not yet been resolved.

      How long until you need to renew your visa? Also, if the college’s licence was withdrawn, the UK Border Agency should have contact you to inform you your permission to stay was now limited.

      Could you fill us in on some of the details?
      What is the college telling you? Are they still under suspension or is it something more serious?

      Your visa application should be placed on hold by VFS if your college has its sponsor licence suspended whilst your application is being decided.

      What is the name of your college – have you checked that their licence suspension has been lifted?

      Have you heard back from VFS yet regarding your application?

      I assume by know that you have had your visa refused or has the embassy still placed your application on hold?

      It would be great if you could tell us if the college is still suspended, if your application has been refused and give us any updates you’ve had from the UKBA, since Tudor College has been off the register for some time now.

      If your college is suspended from the UK Border Agency Tier 4 Register of Sponsors whilst your visa application is pending then your application should be placed on hold until the college resolves any issues the UKBA have.

      It is typically taking 3-6 weeks for colleges to be inspected and have the suspension lifted, although if your read through the comments you’ll find examples of where it has taken many months.

      If your college loses its sponsor licence permanently your permission to stay will be limited in the following way:

      - to 60 days if you were not involved in the reasons why your approved education provider had their licence withdrawn (UKBA will not limit your permission to stay if you have less than six months left. You may want to apply for permission to stay with another approved education provider during this time);

      - immediately if UKBA think you were involved in the reasons why your sponsor’s licence was withdrawn.

        to be honest that is not problems students , should home office do something a good to students to look after them to help them , it not easy to saying his visa or her visa has been canceled , cause some student has been applying for PG OR FOUNDATION YEAR witch is not easy to apply anther a college or university , cause you know is available only on januray and septmber ,u should let them study until finished their study after that u can remove colleges or cancel, just let victims students finish study . please. thank u
