hi here i am because i am there due to 320 7a i was awarded with 40 points under tier 4 nothing was fake my docoments my cas my bank statement were well enough. have done ielts with 5 bands eco refused me that i made just one wrong statement infront of him that i did not mentioned my previous refusel older 6 years due to missguided by some one in consultants office and now my 2000 pounds are struk in college they are not giving me back my money what should i do now . in adminstrative review ecm also refused all. i consider it was not intentionly done by me i was miss guided is it possible to find out the sloution i am from pakistan age 37 have two kids and living here i just want to improve my education now i am disappionted and disheart from ukba and lots of more did not understand the real study seekrs wish thanks and regards to all.

Hi Daniel!
I wonder if you can help.
I have applied for T4 visa extension in mid April 2011. That application includes my spouse and two kids 7 and 3 years – both of them were born in the UK.
Still my application is pending and all passports are with HO/UKBA. Our ‘biometric’ has been done in mid June.
Now I have been here in the UK on student visas for 10 years (meeting 10 year long residence rule).

So, my T4 visa extension application is still under process and my passports are with HO/UKBA – being in this situation, may I ask you if there is any way to apply for my ILR.

My spouse is here in the UK for 8 years and my kids were born here. All they are on dependant visa with me. So, if you can suggest how they can apply for Leave to Remain when I am going to apply for 10 years long residence ILR.

Sir

I am from Bangladesh. My name is S M Mahady Hassan. I have been refused UK
visa in September 2007. The cause was 320 for bank statement. Further
application I submitted a new Bank Statement from my Uncle. Then UK Embassy
nothing said about my Bank statement and Solvency certificate. They refused
under paragraph 57 (i), (iv). Then i have been submitted Five times and all
the time UK Embassy refused on the paragraph 57 (i), (iv). I submitted my
papers again on September 2009 then UK Embassy confirm me that all of my
papers are genuine and my Bank statement and solvency certificate are also
true but they refused me for the first cause on 2007 that was 320 and they
deported me for 10 years from 2007 to 2017. I want to know that, why they
refused me Five times on 57 if they deported me from 2007.

Now there have any option to do for visa. Please if you can give me any
solution it will be very helpful for me.

Hi,

I urgently need help, my visa was refused for Tier 4 application, the issue was the bank statement that i submitted, was the summary of the accounts instead of the bank statements and i lost 10 points, however i did have sufficient funds required by the home office rules which i proof to them later on when i obtained my bank statement but it was not re-consider, however i challenged the decision further by appealing to the tribunal and my appeal was dismissed because the evidence rights came out on 23 May 2011 and i was one day late, so now i have just submitted the appeal to challenge further to the upper court. Please advise what is my prospect of winning, why there is no discretion and judging based on fact,fairness and common sense? If someone is able to proof that they have enough fund(that’s the point of showing evident of bank statement) but the method of showing maybe incorrect according to the rules, but it was unintentionally and misunderstanding, where is the flexibility?. I have invested myself for quality education in the UK by enrolling at a university and doing my master degree for 1 semester and my visa was refused when i applied for extension of leave to remain, i will be in trouble and my future will be jeopardized by this matter, i do understand the current changes of the immigration law to screen and keep the quality students which it does make sense, at the same time the immigration must run with common sense, base on fact and fairness and be more human to the human being, i disagree with the rules to restrict the evidence rights, people must have the chance to proof themselves and it is a humanitarian rights. Please help i am so stress, worried as i have been living with the uncertainty for 3 months now, i start feeling sick and depressed from this matter while my appeal is running.

My name is shakil ahmad and i came to uk in 2000 as student and study for
accountancy for six years.After comletion of study and qualifying as chartered
certified accountant i got work perment in 2007 untill 2012.I got marry in 2008
and my wife asked me to switch my visa to spouse as i will better opportunities
instead of stucking with one accountant.So i applied for spouse visa.I present
my wage slips and bank statements with the application.My wife went with me to
home office to make sure that i am switching my visa as i was not happy to
change visa and leave my employer.My wife and in laws when they come to know
that i am under their control they started pressurising me to fulfil their
demand otherwise they will through me out of country.They were asking me to work
on take aways on weekends to bring more money,hire luxury flat,buy new car
etc.There are many things and i was alone could not do any thing against this
unjustice against me.They keep me involve in these things and wife report home
office that marriage has broke down and caurtail my leave in 2009.The home
office send the letter to a adress which i hired on my inlaws demand and i live
there for only 10-15 days.I never recieved the letter of curtailment as home
office did not sent on the adress which i had given them at the time when i
applied for spouse visa.I always check my post from that adress but did not have
any access to the address where letter was sent as this was building and only
authorise person have access to this building as i left the flat and live there
for only 10-15 days i did not change my adress.As was worried about my status
before i apply for ILR on basis of my ten year long residency.I asked my
solicitor in May 2010 to check my status with home office as i was worried about
my visa.He did not show professional competence and called home office and asked
about my status.He asked me to sign the authority letter before he check my visa
status.He told me that my visa is still valid.On basis of this information i
asked him to send my application for ILR on my ten year lawfull residence in uk
but visa refused on basis that my leave was curtail.Now i am going to dallas
court to sign every month and as they were pushing me to put the application if
i want to stay in this country.I have sent the application for desretionary
leave on human right basis.I went to an other solicitor and he saying the
application will be refused soon.I do not know what to do.Sohel give me your
email and he tell me that he already to you about me.I want you to help me in

i had applied for visa extension and i have got my document back with refusal letter saying that i dont have enough money for my maintenence as well i was unable to show money in my accout 28 days (it was 26 days the day when i applied for visa). I had shortage of £90 in my account inclusive my tution fees.

hi Daniel, i wrote you yesterday concerning my visa status but havent heard feed back from you.I met the immigration rules for student visa,my CAS ECO comment was cleared,Statement Eco comment was also cleared making 40points which i’m supposed to get,my very first application to uk was 2009 for a short course for 2 weeks which was refused on the condition that my account was artificially inflated,now 2010,i applied for a student visa which all my requirements were met,i was wrongly refused on the issue i dont even know anything about that i have a passpot issued 2004,and my very first passpor was issued 2007,same i used in applying for my student visa 2010 and same i used 2009.there was never at any time that i was issued any passport in 2004 or applied to uk at the time stipulated.I’m so confused now,i made an appeal stating everything there but having got back from them as this is really disturbing as i really want my dream to come through,i’ve gone through lots of stress concerning this,please advice me,what can i do?Thanks alot.
I’m supposed to resume for Jan session.2011.

my student visa was refused because i was told that i was having a passport which was issued in 2004 and was refused,but there was nothing like that my first passport ever was issued 2007 here in Nigeria at the ikoyi immigration office,i don’t know where they got their facts 4rm,i belief they should beable to prove facts to this because my first and ever first passport was issued 2007,which will expire 2012,have made an appeal now and yet to hear back 4rm them,after going through so much stress gaining admission, paying tuition,paying money to agent and all that,this is so annoying,at as the time stipulated that i had passport i never dreamt of travelling to any country abroad,they should please review my case on time as i dont seems to get myself right now.i want my dream to come true.

Hello everyone,
my case is one of kind coz i have applied for study visa in January 2009 i was refused then i appeal against it and i was allowed by the judge in UK i resubmitted my document with new acceptance letter from college the date was 26 Nov 2009 after 11 months of waiting i received my passport back with again refusal that contain only rejection on the base of MY COLLEGE HAS NOT GIVEN A PROPER RESPONSE TO THE OFFICER SO THEY DO NOT THINK THAT I WILL STUDY THERE and i have given again a time of 28 days to appeal against that.
When i have contacted the college they say yes we have receive your inquire and we have approved that he has accepted for the course they have approved that i have submitted the fee for the course but when i have told them about the refusal on that base they said what else can we say are only job is to verify the student details that they are true or no
NOW WHAT CAN I DO?
CAN THEY REALLY DO THAT?
SHOULD I APPEAL AGAIN COZ THE REFUSAL BASE CONTAIN ONLY ONE POINT ?

REFUSAL COLLEGE HAS NOT GIVEN THE PROPER RESPONCE ON BEHALF OF MY SIDE

i’m Suraj from Nepal..i completed my bachelors from nepal and wanted to do my MBA from the UK so..recently i applied for student visa on 18th oct for student visa…i was granted 30 points for CAS(highly trusted sponsor)but 10 point were denied as the bank statement i provided was my parents having enough money(around 70000 pounds) they said i don’t have access to that fund so my visa was refused…i provided them relation verification certificate from government body…to certify my relation with my parents,i have also submitted notorized letter of consent from my father( Sponsor parent) and another problem was i never made birth certificate instead i had translated(because it was in nepali language) my citizenship through Noraty where there is clearly addressed of my birthplace
my course is starts 29 nov 2010..so i’m really confused m i eligible for Administrative Review?? what are the chances of getting decision overturned…also after the visa refusal i recently made birth certificate can i add it with administrative review?? i heard we cant add any documents for admin review but unless it related with the refusal….i also have enough fund in my own account holding for more then 3 months(18000 pounds) can i also attached my bank statement and bank certificate as a proof for admin review so that i can support myself….thanks waiting

I have applied for student visa from Austria and got refusal notice stating that I have applied more than three months before the starting date of the course (24-January-2011) and I have applied on 4th October (3 months and 3 weeks before). But neither CAS states any information about the validity nor the officer who received our application has said any thing…….I dont know what to do……please help me…….

Really sorry to hear about your situation – must be worrying and frustrating in equal measure.

All I can suggest is that you try to contact the Visa Section directly to chase up the application. You may well need to ask your University to contact them on your behalf and chase the application – we’ve had success on a number of occasions this way with our students.

just wanted to mention it’s good that you’re helping people out, Daniel.

I’m from Moscow and my tier 4 (general) student visa application was refused about 2 weeks ago, cause i submitted the wrong bank statement. so i applied again with the right one afterwards. still waiting for the decision though. it is taking longer now, than it did when i got the refusal. i hope they don’t come up with any more reasons for refusal.
i just think it is really weird, i’ve been studying in UK for the past 3 years in a University. and i just need this final year to graduate. (my previous visa (it was issued in 2007) expired so i need to get an extension).
it is so unfair, because now i have missed nearly a month of studying, and i’m not even sure that the Embassy will grant my visa. i have payed all the fees (they cannot be refunded, now that the Academic year has started), and i have put so much work and payed so much money in the past 3 years – and now i cannot graduate?
this is crazy
i just hope that UK Boarder Agency comes up with more accurate rules. every case should be considered differently, you know

Hope you will be fine. I want to ask a question regarding 320 (A,B). is there any difference between the two A and B. if yes what is that. secondly, i want to know that if a person has got 320 (A, or B) becuase of some kind of mistake which is not deliberate. it means that occured by filling a visit form and the person filled it incorrectly like instead of yes a person tick a no box and other sources are available like passport has exit and entry stamps. does the ECO will only look into the form only and nothing else. wht will be the solution. i have another question as well. if you dont mind pls tell me that if a student got a wrong CAS number from the college and he has been convicted of 320(A,B) then who will be responsible in the back drop because the college also sent apologise letter to this student also. and what will be future of the student. pls do reply me

had applied for tier4 visa but it is refused under para 320(7A). i had attached my employers letter that was issued some internal department not the authorised department.my joning date on letter was mistakenly typed as 1 july 2010 whereas it was 1 july 2006.and my resignation date was 20 july 2010 which is correct.
when Uk home office contacted my employer the authorised department said that this letter hasnot been issue by them but they provide my complete information to uk homeoffice including my duration and salary.
i had mention my same employment duration also on my application form which was confirmed by my employer to UK home Office.Only the typing mistake was on the employment letter that i had submitted with the visa application which is 2010 instead of 2006.

Rest i get my 40 claimed points.Guide me what should i do now??
Should i ask for admisitrative review and attach all my joining and regination letter or should i take new letter from my employers to satisfy the ECO??

Hi, I am from Pakistan and i had applied to united kingdom on the basis of student visa, but my application has been refused on this decision that my tier sponsor did not mention about any assessment of my English Language proficiency and also not awarded any CEFR Level for it, whereas, it is clearly mentioned in my CAS Letter that i had been interviewed via skype video call by the college and the college accessed my level and assigned me level CEFR B1, and this is equivalent to the requirement of applying to UK. Also the british embassy asked me to send them back my case for admisnitrative review in case if i am not satisfied with the decision they made. Please do let me know what should i do and what i mention for administrative review. Thanks regards Atif.

Hi. Please help me I am worried because my visa was refused last 14 of April, I decided to appeal and I won but I did not received any letter or information of the Home Office what happened after that, how long do I have to wait to get my visa or whether the home office has appealed to the resolution of the court…..

my visa was refused recently, reason mentioned was that i did not provide them with my tb (medical) cetificate, which i had attached with my application orignal + 3 copies of it.But Eco did not see it, no other reasons given. my course starts on 27th of this month i have paid all my tuition fee + my accomodation rent. I dont know what to do…any suggestions guys….i am really gutted by there decision.

Dear Daniel, my TIER 4 Visa application has been refused, I have been accepted at Manchester University, and I suppose the financial 10 points were not awarded to me.
I’ve been told I can appeal, do you know how long does this take?
Or can I re-apply?
my course starts in less than one month.

he specific case, my sponsor is my stepfather, although I have not been legally adopted.
I provided them two bank statements, one on my setdad’s company’s name, another on his name with me as a beneficiary.
He has sufficient funds to cover my expenses, do you have any advice to prove that he can cover my expenses? any further supporting documents?

dear daniel,
I applied for a tier 4 general stdent visa last july 30. I got the result immediately last aug 2 and i was denied.
Reasons:
1. in the bank certification, it was not written if my account exceeds 28 days.
2. In the passbook: i opened an account june 24 and the last date written is june 30. Even if i updated my passbook 2 days before i applied (july 30)
CAN I MAKE AN APPEAL SINCE I BELIEVE ITS A MISUNDERSTANDING?
Reasons:
1.the bank only uses templates on their bank cert thats why its not my fault if it is not written there that my account is running for lets say a month. In addition, i believe that you will see the number of days by looking at the date i opened the account and the date when i made the bank cert.

2.if you are holding a savings account,if you do not have any transactions, the passbook will only be updated every end of the month. I applied last july 30 and 2 days before that i updated it but the only transactions that are visible were for jun 30(tax and interest) the tax and interest fee for july was not visible since in order for it to appear i should update it by aug 1. THE ACCOUNT IS STILL INTACT UP UNTIL NOW.

DO I HAVE A GREAT CHANCE? THANK U

hi daniel,

i applied for my uk visitor visa on 8 july 2010 along with my wife.

in the form there was a question which asked whether i have ever been convicted in any country incluing traffic offences.i ticked on no but when i was studying in uk i was convicted for driving under the influence of alcohol which was way back in 2004.
to tell you the truth i really forgot that incident and infact i went to uk even in 2005 to attend my convocation.during my visit in 2005 also i ticked on no for the same question but i was granted visa but this time i was refused.i had no intention to lie.

i was looking forward to come to uk for a holiday but now it seems impossible as the officer has even banned me from entering uk for 10 years.
i really want to visit the place where i studied.

how do i go about it now??
how do i appeal???

please help me!!!!!
