New Rules for Student Visa Extension 2011

From 21 April 2011 there have been many changes to Tier 4 of the UK’s Points Based System. These changes do not just apply to out-country applications but also to people applying for a student visa renewal. We’ve put together this quick overview of the new student visa extension requirements following a lot of questions and searches from you.

New Student Visa Extension Rules for Students of Highly Trusted Sponsors

  • Courses at NQF level 3 or above
  • English language courses at level CEFR B2
  • Courses with work placements that form an assessed part of the course

New Student Visa Extension Rules for Students of A or B Rated Sponsors

  • Courses at NQF level 4 or above
  • English language courses at level CEFR B2
  • No courses with work placements that form an assessed part of the course below NQF level 6

New Rules for Student Visa Extension: English Language Ability

  • How your sponsor assesses your English language ability will now depend on:
  • When your CAS was assigned
  • What type of course you are studying
  • What type of education provider your sponsor is
  • At any time during your application, whether in-country or out-country, you may be called for interview to check your English ability. If your English level is clearly not up to standard, your application may be refused and/or you could be refused entry to the UK at the airport.

Student Visa Renewal: If your CAS was issued before 21 April 2011

  • The old rules apply for your CAS to be valid. That is, if you are studying a course below NQF level 6, or an English language programme, your CAS will be valid as long as your sponsor assessed your English language level to be CEFR B1.
  • Those students who did not take English test, but instead had their English level assessed by their sponsor will still be able to make an application with a CAS assigned before 21 April 2011.

Student Visa Renewal: If your CAS was issued on or after 21 April 2011

  • Have English at level CEFR B2 if studying a course at NQF level 6 and above
  • Have English at level CEFR B1 if studying a course at NQF level 5 or below

Student Visa Extensions with a Recognised Higher Education Institution

  • If studying a course at NQF level 6 or above at a Recognised Higher Education Institution:
  • Your sponsor can choose how to assess your English ability, including administering their own tests. Students will have to be assessed in the four skills: reading, writing, speaking and listening.
  • With the approval of the Academic Registrar of the education provider, “gifted students” can have the English level requirement waived entirely.

Student Visa Extensions with a non-Recognised Higher Education Institution

  • Students studying courses at NQF level 6 or above must demonstrate their English level in all four English skills at level CEFR B2 by presenting a Secure English Language Test certificate.
  • Students studying courses at NQF level 5 or below must demonstrate their English level in all four English skills at level CEFR B1 by presenting a Secure English Language Test certificate.

  • hi, my name is manana. the license of my college is suspended and don sure when it s be back. I need to apply for extension. I ve got visa till 8 sep. I applied for IELTS exam for 13 August(nothing earlier. want to know do I still have time to find a new college and apply for a visa.

  • Hi I have completed my Post Graduate Diploma in Business Administration which is NQF level 7. I entered UK on 21st March. I have successfully completed my PGDBA in Jan 2011. Then I have made an extension for the top up MA in May 2011. I dint write the English Test. Is it possible about my vIsa? Can anyone tell me.? I made it through post….

    i am studying in higly trusted college.but it is a private college.my vis expires on this december.when i renew my visa, will i able to work part time .for new rules apply for who already in u.k or new students.

  • my college was suspended last sep2010 and revoked dec2010,but college was go for legal procedure from last september.but about this student wasnt inform either college nor UKBA.when we got to know it was 60 days gone.in that time we send mai to UKBA and they replyed to cange the college.but college told us though case is still under court we can wait and see.last 16th may2011 college lost the case.we again sen message toUKBA.they replyed same,to change the college.but now i have to sit for B2 as well. now my question is till now am i stayed here legaly till now and can go for change college ,UKBA will consider me or not.now i am so much in tance.and other way i am in this country around 8and half years…….so please can u help with giving me advice. thnx

    • It depends on your scores. Since April 2011 the UKBA has changed the required language level. Your now required to score 5.5 or above in all of your component scores (i.e. Listening, Speaking, Reading and Writing). If anyone of your component is under 5.5 and even if you previously got a CAS from the highly trusted college, you would need to take he test again to meet the UKBA requirement.

      dear you nead atleast 5.5 band in each module (IELTS)
      atleast 59 sore in Pearson PTE exam
      and B2 level in ESOL cambridge….If u have taken ur IELTS date before then well and good otherwise its very difficult to take exam date upto august.

      you can gave any test from the above.

    Lets just dont get scarred of the changes uk government plans for the internationals. There is no need to be scared of,keep faith in God and keeping stepping ahead.
    Bringing changes for good should not be worry some….it is in the country s interset and millions are associated with these law

    I submitted my tier 4 visa application at VFS Ahmedabad/India on 30/12/2010. The status of my application has been the same since submission – “Your application is under process at the British High Commission.” My collage is London School of Business & Finance(MBA 1 Year course). I missed my Jan semester i get extension for April 2011 but till days i can’t get any reply from embassy, My collage is started on 25/04/2011. I send a fax to deputy high commission. I don’t get any reply. I get a call from embassy in feb/2011. How much they take time?

  • I have applied my student visa on 1st April from India. I have applied for NVQ level 6 course. Can i bring my dependent in June 2011. I am afraid because of new rules for student sponsor for dependent from 21st April.
    Please let me know whether I will be considered in new rule or old.

    • Dollar Abroad Education

      Students applying for student visa and had taken admission in private colleges will not be allowed to do part time jobs. Only students taking admission in Universities will be allowed to work part time. This is only for new admissions and student extending their visas.

  • The more positivity I try to put in my mind about the immigrations and Visa Regulations in this Country, just at the same time, the more negative it gets.

    It seriously puts me off, as we as a student in this country now, are getting so stuck, as the country’s economy is really really being hit so hard that we are scared of getting a good job after completing our studies. Might or might not be we are able to get a good job, but one thing remains for sure. I tend to leave this country as I have finished my studies now!

  • Hi, I am currently studying ESOL Higher in Scotland in Highly Trusted college and I have Scored 5.5 bands in IELTS but my IELTS has been expired now and there is another but I applied for HND course in the same college before my IELTS had expired i.e. in Feb and got my CAS on 20th of April and I will apply for extension in last week of July.
    I have told our international student Consultant (whatever you call them) of the college about it , he told we that I will mention on your CAS that u have applied before your IELTS had expired and we will also mention about the ESOL Highers which you are doing right now in your CAS.
    So under these circumstances will I get the immunity from new English language requirement?
    Or should I take and IELTS test before applying for extension?
