As you may be aware the rules for getting a UK visa are going to change:
- From March 3rd 2010 students will need to be level B1 on the Common European Framework of Reference (CEFR) in order to qualify for a student visa. Level B1 is equivalent to an IELTS score of 3.5 – 4.5, which means between a good pre-intermediate level and intermediate. There is still some confusion about this.
- From March 3rd, students on GSVs will only be allowed to work 10 hours a week, not 20 hours.
- Make sure you don’t get refused by the embassy or at the airport because you can’t speak English. You can do this by ensuring that you:
- a) complete any online English test yourself; and
- b) check that you can answer basic questions about yourself and your reasons for wanting to study in the UK. Recently, some students who had actually got their visas had them cancelled at the airport in Britain when they arrived. Checking your spoken English before you apply for a visa will help to prevent this.
- At the beginning of April a ‘Highly Trusted Sponsors List’ will be issued. All schools wanting to offer courses to students needing a visa will have to apply to be on it.
I hope you will agree that it is in your best interests as well as your education provider’s to try to ensure that students have a high enough level of English to get a visa.
Please note: until March 3rd sponsors can still accept students at A2 level as usual therefore I would suggest that you send any applications that qualify as soon as possible so that they can be processed before the 3rd March deadline.

Sorry to bother you again, i have a question (i might be daft here) but according to the rules applicable to Teir 4 from the 3rd of March there is this one bit which is confusing me.
It is the bit at the very end which says ”
If you have submitted and paid for your application prior to 3 March 2010, you will be considered against the rules in force at the time. Further changes will be introduced from April 2010.”
Do you know what do they mean by saying you will be considered against the rules in force at the time.

Happy to clarify this for you.
What they mean is if you have submitted your visa application with the relevant fee before the 3 March, your application will be judged by the old rules. Your permission to enter the UK will also be based on the old rules. So, the course English requirement would be CEFR A2 and you would be permitted to work for 20 hours per week.
If you make your application after the 3 March, you would be subject to the new rules. In other words, your course would have to be at level CEFR B2 and you would only be permitted to work 10 hours per week. The new dependant rules would also apply to you.
The thing to take away from this given the deadline has passed is that any application for a UK student visa now made will be subject to the new rules.

i am really disappointed here please reply me as soon as posible otherwise i am just planning to go back in my country. acctually the problem is that when i came here in uk then after 2 days my sponsor college’s licence cancelled and they didn’t returned my 2000 £. then i took admission in new college and deposited 800 £. now the new college rating is B and im really afraied that if it also goes under cancelation. so now i want to take admission in the new college. would u plz tell me that either i need any attendence letter from previouse college or not becaz they are asking for full fees then they will issue me the atendence letter. plz tell me what i should do then.

Sorry to hear that you seem to be having a stressful time of it.
Was your first college’s licence cancelled or just suspended? If it was just suspended, I think your problems began when you switched college the first time, following the suspension of their licence. As you were right at the start of your student visa, you would have had plenty of time to wait for the suspension to be resolved and then change sponsor, if necessary. At least then you may have had a valid claim to a refund and available redress in the courts. Please provide some names of the colleges where you have and are studying.
No college should charge you money to issue an attendance certificate. Are they asking for outstanding tuition fees or is the charge for the letter only?
You will need to extend your visa – I would strongly suggest that you don’t leave it to the last-minute, but do it as soon as possible.
I would also reccommend you consider insuring yourself against loss of tution fees. This can be very reasonable at around £100 for a year. Let me know if you want further details.

I made my last visa application AFTER October 2010 and i wanted to find out; if i make my new Visa application does that mean that i have to pay the fee again?

I assume you mean after October 2009. You will have to pay the appropriate fee again if you make a fresh application.
When you are applying from within the UK, you have to satisfy different maintenance criteria:
If you’re studying in London, you need to show access to £800 per month for two months = £1,600.
If you’re studying outside London, you need to show access to £600 per month for two months = £1,200
You can book premium appointments over the telephone or online. You need to allow time for your appointment as you will need to give a reasonable amount of notice.

Dear Daniel,
My name is Indika Wanigaratne and i am writing to you regarding my student visa application rejection. My visa was due to expire on the 30th of September 2009 and i sent my papers to the UKBA on the 30th of September 2009. I received a letter from the UKBA on the 30th of October 2009 saying my application was invalid as my bank did not allow the fee to be taken even though i had funds available. I then sent in a fresh application on the 14th of December 2009, and the reason why it was delayed was because i was in Hastings doing my placement which is a compulsary element of my masters course and only managed to return to London where i reside on the 11th of December 2009.
Having contacted the UKBA and explaining to them why it was delayed i sent in the application with a letter written about my situation. I received a letter from UKBA on the 20th of february 2010 saying my application was rejected on the basis of lack of funds and with no right to appeal. I now wish to submit either a new application or a reconsideration letter with all the supporting evidence to show that i have been having the necessary funds in the UK through my and my parents bank statements and the reason why i could not show them in the first instance was because i failed to read the guidelines properlly.
Due to the nature of the course i am not in a position to leave the UK as it would seriously jeapordise my studies and the successful completion of the course i am studying and i would very much appreciate if you could help me on this matter. Please be kind enough to let me know, what actions i can take and whether i could write a reconsideration letter with all the supporting evidence,i.e additional bank statements to show the availability of funds.

What college are you studying at? For their bad treatment of you, they really do deserve to be named and shamed.
As you’ve already made payment to them and therefore have a legally binding agreement to pay installments in place, I personally would be reluctant to do anything otherwise. Your college should not just change the terms of your contract. However, your college does sound slightly suspicious as they have charged you for documents – are you sure this wasn’t just a deposit, or contribution towards tuition fees, or was it really a charge for documents?
You can change sponsor under the Tier 4 system Haseeb, but it depends on when you were granted your student visa: before or after 5 October 2009.

I wouldn’t advise your husband to travel as he may well experience problems at his port of entry. The UK Border Agency advises students of colleges whose licence has been suspended not to travel and I presume this would apply to dependants too.

Just because your child was born in London, it has no rights to nationality. This was ended a while ago by the Government. A child only has rights to nationality if a parent has indefinite leave to remain or British Citizenship.
Is your wife’s student visa still valid? If so, you and your baby may be able to come back as dependants. This depends on several things.
You could always come back to study another course, or if you are skilled, could apply under Tier 1 for highly skilled migrants.

You shouldn’t have a problem extending your student visa – you won’t need to explain the study gap from December – February.
But you must start your new course no later than 1 month after the date you apply to extend your visa. You can do this from within the UK.

The new rules coming into force on the 3 March 2010 will affect dependants in the following way:
– ban students who are studying on courses of six months or less from bringing their dependants with them to the UK; and
– ban students’ dependants from working unless they qualify in their own right under Tier 1 (General) as a highly skilled migrant or as a skilled worker under Tier 2 General, Sportsperson or Minister of Religion.

From 22 February 2010 onwards, Education Providers in the UKBA Register of Sponsors list can only assign CAS to the prospective students as Phase 4 of the Tier 4 PBS will be fully implemented. Visa Letter will be valid till 21 February.
Highly Trusted Sponsors list will be published in the beginning of April. Only those Sponsors in that list will be able to assign CAS for students who wish to enrol below degree-level courses in UK.

YOu may have noticed the deliberate mistakes in my previous email. These are illustrative of the kind of English being delivered at most colleges AND universities – who do not have an IELTS 6 as a minimum standard.

I know I have; I share your irritation at these fundamental mistakes. The ironic thing is many native English speakers make these errors too, which in my opinion is a much greater crime.
Fake English certificates are certainly a major problem and the Government will be taking steps to solve this issue: by summer 2010 there will be a government administered system for English level tests which is a giant step in the right direction.

I don’t think that attaching such a high English requirement to the student visa itself is the best approach to take.
I think what you’re really saying is that courses of a certain level should have stiff entry requirements. And most do – the old breed UK universities need 7.5 IELTS, good universities require 6.5 – 7 and what used to be the polytechnics require a 6.0.
Raising the English requirement at the visa level will completely destroy the UK’s English language teaching sector; England is the home of the English language and imagine not being able to study it there! Placing such a bar basically says to the world, “you can study English in the UK if you don’t need to study English.” Quite absurd I’m sure you’ll agree.
Quite rightly a Government can’t dictate entry requirements to education providers. Given that the education market is such that students of all abilities are catered for, how do you envisage bringing in a minimum standard?

Hi Daniel and thank you for your reply. I appreciate your time and insight into the issue.
My points are:
1. Many students who arrive to complete studies (other than English) cannot cope with the English level of teaching for subjects other than English at both colleges and universities. I experience this as a lecturer at a college and have colleagues who bewail the LOW entry level for non-English course students – at other colleges and unoiversities as well. Our college had laid on FREE English classes for the majority of foreign students in attendance to help them BUT we both know that “crash course” programmes are NOT the answer in the medium to longer term.
2. This, in turn, affects the motivation of the student to study and they will in all possibilty fail their exams.
3. The UKBA will then come down on the college with regard to their recruitment programme and might penalise the college. This is unfair because the UKBA standard for admission is much too low.
4. The college will be penalised: the lecturer might be accused of being a bad teacher: the student might be demotivated et al. The college might be dropped by the course providers because of the LOW pass rate – caused by a poor knowledge of English. This is not fair on the college either.
4.1. Colleges seeking to raise their profile are placed at a disadvantage by students who bring down their pass rate because of an inability to write, speak and comprehend basic English – never mind academic English.
5. My college is now insisting on a VERIFIED IELTS score of 6. Some of our current students claim to have 5 and 5.5 IELTS scores and, as an IELTS teacher for many years, their results are not true. They are either forged; the examiners were bribed; or the examiners needed their heads examined.
I agree that the UK is the home of English and that is why I suggested that students FIRST pass an IELTS score of 6 at a British Council establishment in their home country. By allowing students entry to our country to study without having a working use of our language is misleading and borders on deceit.
I am personally aware of FORGED English qualifications so we need to have a closed system whereby results can be independently verified by the UKBA / COLLEGES / UNIVERSITIES.
May I suggest that the UKBA consults with all the stakeholders to debate and address this issue in a democratic and open manner?
The UKBA is doing a great job in border control BUT we do need to TALK with each other – please!

Hi Bruce – thanks for coming back to reply and contributing to the debate. It’s great to hear the views of someone on the front line. You also are clearly passionate about your role as an educator, a trait worthy of praise.
I agree that the vicious circle you’ve described can cause severe damage, yet much exposure can be mitigated by the colleges themselves: simply set higher standards! The glare of £ signs has corrupted many, I feel.
However, under the framework you’ve suggested, would colleges with low standards of English not fizzle out over time? Poor performance with awarding bodies, poor student attendance due to poor motivation, negative image of college etc.
I think good schools and colleges recognise the problems you’ve described, hence their more stringent requirements and your college’s own alignment on this issue. New UKBA regulations will help to weed out colleges with poor standards – for example, one key component of the new Highly Trusted Sponsor list is a no-show rate of 10 or 1% (whichever is less) per year, which if exceeded results in immediate removal from the Register.
Combined with the current Government’s plans to introduce a central and secure English testing system, I think we’re moving in the right direction. However – and you stress this too – their needs to be: a) consensus within the industry; b) efficient representation of the industry by key groups; and c) a culture of openness and consultation from the UKBA. Sadly, I think c) most unlikely of all to happen, if more so with the pressure of the up-coming General Election.
I do think you’re right Bruce – it is quite absurd to think that someone should be able to study a so called course of further or higher education, without a grasp of the language in which it’s taught. A native English student of degree age would not get away with studying a degree/equivalent course in say France, without the necessary language skills. I should know – my brother-in-law taught himself French and won a scholarship from the French Government to study his PhD there.
I’d certainly be interested in the paper you mention – has it been published in a journal or is it an online piece? Let me know further details and I’ll definitely give it a read.

London SAM has been suspended for sometime now. This is jsut a suspension and the issue is currently on-going.

dear i want to know that how long UKBA will take to announce the result of London SAM college.It is still not showing in list.Is there any specific time duration to announce the removal of the college from list or coming back into the list.I hope you will understand my question.

It’s really hard to make predictions about when a sponsor’s suspension will be resolved. The time-scales involved in the whole process are quite drawn out and don’t forget that colleges need to wait for a UKBA visit to be arranged. After the inspection, 32 days is set aside for correspondence before any final decision is taken. Should the UKBA require a Sponsorship Action Plan to be implemented, it obviously has to be drawn up first, which can also delay resolution.
The college are the only one who will know inspection dates etc as they will be in direct contact with the UKBA. I will contact them again for an official update.

As i also tell u before that i m a new student of londonsam.And u also know my college license on hold.My question is that should i contiune my study with london sam until the decision of my college not made.
