Dear Daniel.
My wife – filipino, used to study in majestic college. while here ‘study’ the college lost their licence, (until now ). she left it to transferred to the other school, after some time we met, married and forget about it all (she get EEU visa, so no need for student visa anymore) but recently owner send letters to her work place, family address in Philippines and our home in uk.. also they keep calling to her work place making her uncomfortable, they threat her, they will send a debt collector if she will not pay remaining balance.(for full period of study -no money was return, from what she paid already)

I should mention that they send a letter before, explaining that she doesn’t study any more and is not entitled to stay in uk (they expect her work place to fire her) they stayed in letter the company may cause penalty for hiring illegal workers and in same envelope they put the statement that my wife is no their student.. (she was in other place already)

I’m not uk citizen, I’m EU, and not know well English law. should we go to citizen advice? can u give any hint what to do?

In 12.04.2011 i have been submitted in my application to High commission on sylhet VFS. after four days I’ve informed by my friends my college is LONDON BUSINESS ACADEMY banned from tier-4. Now please kindly request to you now what can i do. What college are you studying at?

The UKBA advises students not to travel where their sponsor’s licence has been suspended. Some students who have travelled regardless, have been admitted to the UK. Others have had their visas cancelled and returned to their own country. A lot depends on who your sponsor is.

It’s clear that you travel entirely at your own risk.

Dear Daniel,

I’ve paid £4k to London Tottenham college in December 2009 for 4 offer letters for my relatives. Unfortunately, UKBA has suspended all the visa application from January 2010. That’s why students couldn’t apply for the visa.

Now college is not refunding any fees. eventhough they’ve no refund policy advertised at their website. I’ve not been asked to sign any application form on the students behalf.

I’ve complained to ASIC. But after 3 months they said, they don’t want to intervene on college decision.

Would you please advise me if there is any chance of receiving refund? Shall I complain to UKBA or go through the court action?

Hi!
Could you please help me clarify the real status of London College of Advanced Studies as it’s suspended at the moment? As to reasons, I don’t know. The head has been telling the students though that the college would get its positive result soon, but how soon since we asked about it months back? Lately I rang the college again to inquire and the lady who answered me said it’s 80 to 90 percent the college would get a positive result next week or the coming week. We are still asked though to attend classes regularly which we are doing as they are strict with the attendance even telling us they will gonna report us to the home office incase we don’t attend. Is it possible for you to find it out for me the real status of the college? I have applied for a work permit and I am afraid it might affect its processing. Shall I wait until the suspension is lifted or shall I move to another college? My visa will be expiring on May 2011. Also how long does the suspension last? At least this would give me an idea if the college is really passing the criteria or be permanently withdrawn.

How can we prosecute Lina Barrameda, Mark Valmoria and John Eric Valmoria?They have again victimized so many filipino students through their agency called “Gacrux Agency”. The innocent victims didnt know with the fact that the owners were in fact the same as the evil Genesis UK/Genesis Manila who swindled hundreds or thousands of filipinos. After learning of visa refusals, the agency closed without prior notice and nowhere to be found. Their Office can no longer be reached or contacted. They have gained Hundreds of thousands of pesos from the filipinos.They should rot in hell.

hi, i need your advice please, i applied for tier 4 extension in november 2009, i received acknowledgement from home office, after 1 month my college got suspended from tier 4 register. i have finished my couurse in april, and degree was awarded in july. Uptil now my decision has not been taken. i asked home office in writing that my degree has arrived. the home office said, “that my application is yet to be decided, and i may therefore wish consider varying my leave. I am really confused as what to do.As i have dependants aswell and some of information of passport details is missing as i did not take photo copies of passports.Today i have seen that college is back on register. What should i do, please advice me.

Its me Aayush again… As i told u i am the student of New London College and now we got notified that the lisence of college have been revoked…but still there are classes being held which i think is worthless…. College told that they will transfer the students to other college as soon as possible and those students who wants to change on their own will be refunded very little… which is not fair…college told us that the amount they gave to the agent will not be refunded and the first semester fees will also not be refunded.. is that the rule of UKBA then we are going to face a big problem.

And another issue is that the college was telling to those students who had came to UK in or after January 2010 has to re-apply for the Visa and all….is that true?
As u said previously that ‘Remember that even if the college has their licence permanently withdrawn, they are still responsible for their students already in the UK.’… but the college has a different thing to say to the students….
Can u please give us any suggestions… thanking you

I have my CAS number provided by the University of Lincoln, payed half the fees and everything they told me. My question is relative to the institution that will be paying my expenses, which is a Mexico’s State Government Cultural Institution (the National Institute of Anthropology and History), where I work. I have been told that a letter from this institution assuring they are going to pay my complete fees and living expenses could not be accepted for the visa, is it true?

Thanks for your comments, which have raised some important points.

I think major flaws with the BAC accreditation programme have been exposed, which has resulted in many colleges being suspended. Licence suspension has clearly put students in a tight spot, wich which you eluded to: how can you pay money to a business who’s very survival is under-threat (whether legitimate or not)?

The problem is that the UKBA’s policy is that sponsors remain responsible for students already studying in the UK. They are obligated to continue teaching students who are already here. This is why they are asking students to pay their fees and if payment is not made, do retain the right to cancel a students registration and inform the UKBA. Whilst the situation does favour sponsors, there is little else a student can do. You could change sponsor, but would probably not be entitled to a refund.

How has it come about that you have overpaid your fees? Please provide further details. You should be entitled to any overpayment back.

I feel for your brother’s position but I imagine the college’s terms and conditions do state that if their are insufficient numbers, courses can be cancelled. The school should have offered to cancel your brother’s registration and refund his fees if they could not offer a course at a suitable level. However, as your brother made no protest, didn’t study regularly – I assume from what you’ve written – and more importantly, didn’t sit the exam, he is probably in breach of his registration. He should of taken the exam, even if he flopped. He may well have no legitimate defence to his suspension. Please clarify – has he been suspended or had his registration cancelled?

Remember that even if the college has their licence permanently withdrawn, they are still responsible for their students already in the UK.

Hi Daniel,
I am a student of New London College which had been suspended since December 2009. I am here with my brother. Its been 9 months that college had been suspended. We have paid more than our fees. The college don’t want to refund our excess money. And those student who has to pay to college like just 10-50£ have been suspended. The college wants everyone to pay all the fees or else the students get suspended. The college is suspended and it is suspending the students. We want to change the college but the college will not refund our fees. And the excess fees they are telling that it will be transfered to the other course in which i was not enrolled to.

And there is a different issue with my brother. He was enrolled for certificate level but there were only 2 students so the college didn’t taught him and kept him in Diploma level. he couldn’t study and felt hard and didn’t gave the exam and the college have suspended him. He has paid more than £5000 and he has got 18 months more visa left. What should he do? Should we complain to the UKBA.
Give us the best suggestions

Are you sure their licence has been permanently withdrawn and not temporarily suspended? Please give some more details.

You can of course change sponsor. How depends on when you got your student visa: before or after 5 October 2010.

I’m nicasio an applicant for student visa in Majestic College in UK. I have already my visa letter issued last Octber 7, 2009 and I lodge my application in embassy also last December 15, 2009. Sad to say that my application for Majestic college was refused by the clearance officer because the licence of Majestic College was revoked by the UKBA, therefore my visa letter was not valid.The result of my application in embassy was April 16, 2010.
