Schools Removed From the Tier 4 Register – Help my School or College is Suspended!

In this the third post of our series on schools and colleges removed from the Tier 4 Sponsors Register, we’ll be looking at what happens to students who’s education provider has had their sponsor licence suspended or withdrawn.

What happens if my College’s Licence is suspended?

If an education provider’s sponsor licence is suspended and they are removed from the Tier 4 Register of Sponsors, any new applications from migrant students will not be considered by the UK Border Agency. Applications made by students will only be considered once the sponsor’s suspension has been resolved.

If a student has been issued with a visa using a visa letter or confirmation of acceptance for studies from a sponsor who is now suspended, they are advised not to travel to the UK. This is to avoid problems with entry clearance officers at your point of entry to the UK. The UK Border Agency should contact all students who are in this situation once the suspension has been resolved. However, students should remain pro-active and continue to check the Register of Sponsors to see when their education provider is re-included.

What happens if my College’s Licence is withdrawn?

If your school or college’s licence to sponsor student migrants under Tier 4 of the Points Based System is withdrawn, the UK Border Agency will take the following action against that education provider’s students:

  • If you are involved in the reason for your sponsor’s licence withdrawal, you permission to stay in the UK will be ended immediately.
  • If you are not involved, your permission to stay will be limited to 60 days. This will give you a chance to find a new sponsor. If you have less than 6 months left on your student visa, your permission to stay will not be shortened.

If your permission to stay in the UK is ended, you will have to leave the UK immediately, or force enforced removal from the UK. If after 6 months you have not found a new sponsor, you will also have to leave the UK or face enforced removal.

If you remain in the UK after your permission to stay has expired, you face action from the UK Border Agency and Police. You could be detained, forcibly removed from the UK and blacklisted from coming back to the UK for 10 years.

I haven’t travelled yet and my College has had their licence permanently withdrawn – what should I do?

When an education provider’s sponsor licence is withdrawn permanently, any visa letter or confirmation of acceptance for studies issued by them becomes immideatly invalid. Therefore, any application made using this documents will be refused.

If you have already received your student visa but not yet travelled and your college’s licence is withdrawn, you must not travel to the UK. Your permission to enter the UK will have been cancelled and you will be refused entry if you do decide to travel.

    i came back my country for extension my visa. About 5 days ago i called for the college ( St John’s college, London : +44 (0) 208 901 7668 ) to confirm that i ll come late. After they said they have spoken to the UKBA and they accepted it.
    2 day later, i got an interview by phone from UKBA in Thailand but they didnt say i got anything wrong about Cas letter or college.
    After that i recieved the letter of college and said they cant find my name on system. And my lawer have told me that the college is out of Tier 4 college list 4 days ago.
    Then why dont UKBA told me about this in the interview? What ll happen with my application now?

    My college already susspend in 2011 I got tier4 visa but I am changing the college but I didn’t tell the home office now igot 6 month visa so I need to renewed the visa how can I tell the home office

  • the name of my college is The london school of computer education.this college has been shut down..the day i went to attend the college i found it be shut down.there was a forwared adress on the door with a different date.. i attended i was told this college has closed.i have paid £5000. and have a visa upto december 2012..i am very confused what to do now?do you have any advice for me and do you think that i should get addmission in another college…thank you

  • hi .. i m khan. i want to change my college. that is to take admission in university. because being in college there are always a risk that might be clossed. thats why i didnt want to pay my remaining fees to college because if it closed than what should we do. and want to take directly admission in the university.so that to secure myself from all risks..,.plz reply me how can i get admission directly in the university. thanks

  • I paid a years tuition fees, received a CAS and submitted an application in April 2011. UNFOUTUNATELY my colleges license was suspended in May 20011.We had inspection in June.we were not informed ofthe outcome.onreturn to college,this semester,our college had disapeared,no website, no office, telephone lines cut, un answered mobiles and classes closed. someone at the premises said that it had gone bust.
    We have had no correspondence from our college as to where we stand.
    Iam confused as I dont know what step to take next

  • I came to study ACCA in Jan 11. I got the 3 years visa (length of the course). Recently, The College has closed down due to problems. Can you please let me know what are my options. Can I enrol at another college and how long can I stay in this country until I find a suitable alternative course/college.

    i am student of anglian college london, before 4 months our college was suspended n then we have got 3 months holiday till 27th of august but when our holiday was finished n we went to college but college is closed, no one giving the answer our college is locked by state agent as well. now what gona happen to us??

    can you please advice me that my college british institute of technology and e commerce just got suspended on 12 july 2011 today, and i am almost near the completion of my MBA just dissertation is left.
    My question is can i apply for PSW as degree was supposed to be provided by coventry university.
    Please advice me what to do ?

  • My college has just informed me that they have been suspended by the home office in Whitechapel.

    I have a visa until 2013.

    My question is where do I stand?
    Do I have any legal come backs. I have studied hard for the past year hoping to complete my course in the same college.

    Do I need to re apply for my visa again in a different college as a student?

    I also got married 6 months ago to a UK citizen, however I am under 21 so cannot apply for a spouse visa. I am aware the rules are still 21 for minimum age.

    What can I do?

    I do not want to go back to my country and then re-apply as a student so I can be with my husband, until I am 21.

    What are my options please help I am stressing out.

    My visa was granted, the same time as yours,in Dec 2009. According to the quotation from Tier 4 of the Points Based System – Policy Guidance as follows, do you think we need to show 800 X length of my course in our statement?

    “How many months money must I show I have?

    A student must show that they have enough money to cover their monthly living costs

    104. whilst they are studying in the United Kingdom. The amount of money a student has to show will depend on whether he/she already has an established presence studying in the United Kingdom. A student that has an established presence studying in the United Kingdom needs to show less money for living costs.

    105. A student (including Post-graduate Doctors and Sabbatical Officers) has an established presence studying in the United Kingdom if he/she was last given permission to stay under Tier 4, as a student, or as a Post-graduate Doctor or Dentist and he/she:

    •has completed a single course of at least six months during his/her last grant of leave; or
    •is currently studying a single course, of which he/she has completed at least six months; or
    •is currently studying and has completed a single course of at least six months during his/her • current permission to stay.

    and

    •his/her last grant of leave ended no more than four months before his/her Tier 4 application was made; or
    •he/she is currently following a course of study.

    A student cannot amalgamate two or more courses to make up the six months study.

    106. A student can qualify for the reduced maintenance levels whether he/she is applying from inside the United Kingdom or from overseas.

    107. A student that does not have an established presence studying in the United Kingdom must show that he/she has money for his/her living costs for each month of his/her course up, to a maximum of 9 months.

    108.A student with an established presence studying in the United Kingdom must show that he/she has money for his/her living costs for each month of his/her course up, to a maximum of 2 months.”

    I am in the same situation like yours..same school !!
    when was your visa granted , before or after 5 Oct 2009 ?

    in my case,my visa valid from Dec,2009 and valid till Apr,2011, therefore i have to find another sponsor and submit a fresh application. I have phoned UKBA and asked them for a clear explanation towards my visa status.They said I actually have 90 days to find another school and i must as well summit the new visa application before 90 day ended.

    I am still confused ” from which date that school’s licence has been removed”?,i got the first email from the principle on 21st Feb, if this can be counted as the first day that’s mean 16/04 isn’t the deadline of 60 days.

    Another point is that I have started the course with Mayfair on 11 Jan 2010 and haven’t completed any course yet ( due to this problem)so how much money do i have to have in my statement ? do i have to show 1600 or 800 X length of my course ? and at least it has to maintain in my account for at least 28 days.

    All this problems are pissing me off so much because i wasn’t informed by the school that i have to make everything all over again.

    If anyone has experience similar to my case, kindly give some advice.

      Good to hear from you! And sorry to hear that you’re caught up in all the mess.

      First, what college were you studying at to start with? And how do you know their licence has been withdrawn and not just suspended? Interesting that the UKBA told you on the phone that you had 90 days, but their website quotes 60.

      As you have not completed 6 months of continuous study, you will not be considered as having an “established presence”. You will therefore have to show the following with regards to maintenance:

      9 months or the length of your course (whichever is less)
      £800 for inner London
      £600 if you’ll be outside inner London

      Inner London is: Camden, Islington, Southwark, City of London, Kensington and Chelsea, Tower Hamlets, Hackney, Lambeth, Wandsworth, Hammersmith and Fulham, Lewisham, Westminster, Haringey or Newham

  • Dear Daniel,

    I am studying at Mayfair English School which is in the withdrawn list. Although my visa will expire in mid-May 2011, my deadline for (60 days)permission to stay seems to run out at the end of this week (16 April 2010). If I apply for the new Tier 4 sponsor sometime before this deadline, do I have to extend my visa via Tier4 point-based system to remain in the UK?

    Since my bank statement has not met UKBA-Maintenance requirement, I therefore need another 28 day period to make it valid. To sum up, by this 16 April, my 60 day permission to stay will have expired (though I may successfully have new Tier4-sponsor at that time); will I be considered as the case “you will have to leave the UK immediately, or force enforced removal from the UK.”? OR.. Will I still have another 6 months for visa application after I had the new sponsor?

    This is habe as i told u that i applied from LTC College London in the month of Nov. still im waithing for my result from VFS Chennai.
    What should i do now ?
    Will LTC get its tire-4 back or not ?
    how should i know ?

    youve been very helpful….you mentioned earlier if the colleges license is withdrawn,you can sue the college for a refund?
    how much of a refund is a student entitled to? we are 2 3 weeks into a semester.
    What procedure can we follow legally to claim our money back?

    The college i go to has been withdrawn,but the owners still operate another college in the uk and are trying to send us all there….which is not realistic..but it proves they have the money..

    please advise how to go about attaining a solution.

    i ve submitted my application at 31st december for the college(london school of business n computing)but in the meanwhile it has got suspend. so i ve sent mail to british embassy abu dhabi. they gave me 2 options i can choose either one of the following options:
    1. Wait the results of the suspension.
    2. Withdraw your application.
    they said i can not change my college at this point.so u plz tell me what should i do..should i ve to wait of college back or i ve to withdraw my case.

    1. Wait the results of the suspension.
    2. Withdraw your application.
    they said i can not change my college at this point.so u plz tell me what should i do..should i ve to wait of college back or i ve to withdraw my case.have u any idea when school is removed from tier 4 list?

    Pls, would like to know the date when London school of business and computing was suspended and any idea when they would be back on the registered list ?? .

    Also pls what can some1 do if your visa renewal application was sent and came back as invalid. As at the date you sent your visa renewal application form the school was still REGISTERED and few weeks later the application came back as invalid noting that the school has been suspended, removed and no longer registered.

    Please what is the next thing to do ??????
