Hi Daniel
Please give me suggestion to refund fee back from college. I already apply Teir4 visa in the end of januaray 10, but in a first week of course (15 feb 01 ) the college was suspened and it seems going to shut down in next few weeks. I have no idea what to do. I already paid all course fee and my agency said I can take money back if :
– college is complely close
( that means no chance to refund money )
– I got reject letter from Home office
( So far I just got letter for fingerprint )
– I’m should be ill and unable in study anymore
Do you know any law that protect student and can use to refund fees for college that not on Tier 4 list any more. I really feel stressful and suffering to talk with staff in college. They just only said this place still open so far.. ( but who know tommorw they can vanish forever). I don’t want to put the name of college for now but if you think that it helpful for give me the solution please reply me or leave me the way to contact you.
To all guys that had ever face the same problem, please tell me how to deal with it

Hi Daniel,I thank you a lot for providing us updates regarding the current situation.
I applied for my student visa on January 7th.like many students am yet to get a reply regarding my visa application due to the suspension of the college.
the UKBA has wasted almost 3 months of precious time of mine and money,a student could do many academic activities during these three months if they were allowed to study at the institutions they applied for,UKBA should have used a more effective and a swift method to inspect and clear out colleges that are been temporarily suspended, because the current system has damaged a lot of students precious time aspirations as well.This treatment of UKBA is very unfair and unethical.
I think this will cause a black mark in UK education system among international students,students will opt to apply for other international education destinations n think twice before applying for UK for their education, because no one would like to pay a college fee and a visa fee and then submit an application n sit at home for months to get a reply.
I honestly regret the decision I took to apply for UK student visa.
By the way thank you Daniel for providing updates in a regular basis,its very helpful.

Hi daniel,
My visa will be expired this march, I already applied for the extension of my visa last week of january and i had my biometric last February 17. Until now i haven’t got received any news if it is refused or granted.
I am worried because I did’t know that my college is suspended because they never been honest with us. I was just surprise that my school was removed from tier 4 registered. Before they gave me my visa letter last January they asked me to pay the full amount of my NVQ3 tuition fee and i padi £650 for the processing fee because they are the one who process my visa extension.
Now, most likely my extension of visa will be refused because the college was removed from register since march 1. Can you please help me what to do once my visa extesion will be refused… and is it possible for me to get my money back.. though it was written there that there will be no refund once it is not successful but the thing is, they never let me know that their college was suspended and much worst now, they were removed from register.
Please help me i really don’t know what to do… I feel so bad because NVQ3 cost me £2320.00 plus the processing fee which is £650 and of course the visa itsef which cost £357..

Hi All,
The UKBA’s intentions are becoming increasingly evident.
If you look at the majority of the colleges that have been added to the register until now, it appears that UKBA wants to delay the licenses of those college who receive a major chunk of international students. Colleges who offer undergraduate courses such as in hotel management, acca, cima, business management, travel & tourism, which are popular fields of study with international students, are being kept away from the register.
Some colleges have stated that once their 2 week period comes to an end after the inspection, the ukba brings up another set of queries and extends it further by 2 weeks.
‘It is now being strongly suspected that UKBA wants to delay this matter until the 06 April when the so called highly trusted list will be published. Considering the current mood of UKBA, it is very very likely that many pvt colleges will not make it to that list.
so basically UKBA wants them shut down. this is since if such college cannot offer diploma and other undergrad courses then they will be severely hit. most of the pvt colleges are not listed bodies and therefore cannot teach degree courses. so this may be beginning of the end for many colleges.’

Hi, i’ve been talking with a few college principles in the London area all were visited and the ukba were satisfied they were doing a good job. The three colleges didnt get suspended as they were running genuine institutions with nothing to fear. The reason why colleges have found themselves suspended is because they have done something wrong….and there are many wrongs ranging from ineffective monitoring all the way to full blown fraud.
Its not rocket science, it is a system that is so easily abused. When the inspectors came they came full force with trading standards and office of fair trading pcso’s and UKBA. They submitted all information and it was over within 2 hours. Its not a problem for straight colleges and those principles welcomed their visit as they do every year routinely and will most like be on the htr. These colleges are fairly small with 100-150 students.

another view that is being circulated is that the UKBA has inspected majority of college with positive results but it is waiting until all college are inspected and then will declare their names at one go. this is since colleges who are approved earlier will have an unfair advantage over other college as it will be able to start recruiting before the other ones.

Wishful thinking, if the ukba suspends your license then you have done something wrong. For the vast majority of colleges they have no problem when it comes to visits from ukba.
Im sure the ukba are satisfied that the colleges are running to a good standard therefore no reason to trouble them. Its when they find something wrong, it usually leads to other things and before you know it the ukba have discovered yet another visa factory.
It is common knowledge among the decent colleges who the perpertrators are.
Take for example a college which open 10 years ago, they are still quite small located in a good area and have a steady flow of students from all over the world, then take a college which opened 2-3 years ago that grew so large to contain 1000 students 90percent from the same country????? the 2 are not equal my friend and the border agency know the difference, so lets not speculate to much on what the ukba are going to do, they are just going to get rid of all the corrupt colleges and they know where to go and from my observations the colleges that have found themselves in deep water are serious offenders and their time has come. and your theory that the ukba will announce who will go all in one will be those who are already suspended. just remember a thief thinks everyone else is a thief but the decent colleges run by decent people havent even been bothered by the visits as they have nothing to hide. Its not just about recruiting thats all you care about, genuine colleges dont need bogus agents sending fake students because their colleges are established and they have honour prestige and a concience, three things that bogus colleges lack.

you can claim your money back. the college is obliged to return your money in case it is not eligible to continue the course for what ever reason , the college is bound legally and morally and contractually to refund the money, should componsate you for what ever you have suffered. i.e. waste of time, anxiety, interest on money as well. so calm down.

Visa letters were phased out on 22 February 2010, so I’m suprised they’ve said they’ll send you a visa letter mid-way through March. Perhaps you could clarify.
And no, they were not on the Tier 4 Register yesterday, 4 March 2010.

i already have my visa letter last dec. 2009 but stil my visa from the embassy was delay until now they say well have to wait until the suspension was lifted?up to when, how many weeks or months?

Their licence was suspended on 1 March 2010, which is pretty recent all things considered.
It can take schools and colleges anywhere from 3-6 weeks to several months to be inspected by the UK Border Agency, for a Sponsor Action Plan to be drafted if needed and to be re-included on the Register.
You should keep checking the master list of college suspensions to see when your colleges suspension is resolved.
Only the college and the UKBA will know for sure. After inspection, 32 days is set aside for correspondence, so it isn’t a quick process. Find out more on the timescales: what happens to my education provider if their licence is suspended?.

All I observe is chaos to the highest order. Strange but true, they say the PBS is straight forward but it is not ay all. A lot of experimentation is taking place. All potential student applicants are taken for guinea pigs. You pay your school fees, you have the money in your account and then some insignificantly little things will lead to refusal.
It’s a bad sign for Britain. Indeed immigration problem is a problem but is this harsh way the best solution. Students undergo so much unnecessary stress for which they are not responsible. Its bad. something has gone wrong within the UK system. Let hope it is resolved quickly.
Everything is suspicious about the UK system these days that you become induced by such chaotic trend of events….very bad….
