Hi Grace

As of 16 February 2010 LAHE is still suspended from the Tier 4 Sponsors Register.

I have contacted them for an official update on the situation and will post anything I get in reply.

  • I know of very few cases where a college has been suspended for so long and then re-instated with an A rating again. I’ll definitley be keeping an eye on this with interest.

    If your college’s licence is currently suspended, I would not recommend travelling – you could face problems with an ECO when you come back to the UK.

    I understand your frustration: how can you prepare the required financial documents without knowing the date of appointment?

    Unfortunately it seems the only thing you can do is to wait for notification of an appointment. Why this system is in place when you can book appointments online in other countries is beyond me.

    Thanks for coming back to me.

    What was the outcome of your appeal? I’m still quite surprised that they did not offer you the chance to resit your exams. Most allow this, but of course severley restrict the grade you will be able to achieve.

    What university are you studying at?

    I think that as your extension came after 5 October 2009 this brings you under the new Tier 4 rules. You should check this with the UKBA yourself.

    If that’s the case, you will need to make a fresh application to change sponsor. The rules for changing to an A or B rated college have now changed: you will have to wait until you get permission from the Home Office before starting your course. If you are changing to a Highly Trusted sponsor, then you are able to start your new course immediately, but entirely at your own risk.

    As your university has cancelled your registration they will have no choice but to report this to the UKBA. You should therefore give this matter your urgent attention and get your status sorted.

  • Student Visa Extension – Errors on Application Form
    Hi Jay

    You need to look carefully at the documents the Home Office have sent you. Have they permitted you to make another application? Have they told you you must leave the country?

    If you apply again, you will need to fulfil all the criteria of the application. So, you will be subject to the same maintenance requirements.

    You should submit your application ASAP as you currently have no valid leave to remain in the UK.

    You will need a new CAS number as each one is only valid for one application. Check this with your sponsor.

    Given the details of your case, it would be worthwhile to discuss the details with a fully regulated immigration lawyer, details are available from the OISC.

  • Points Based Tier 4 for Students to be Phased in Next Year
    Hi Adeel

    As a guide, your dependants should include:

    - evidence of their relationship to you;
    - evidence that you can support them and live without needing any help from public funds; and
    - a copy of the pages from your passport/travel document showing your permission to stay, if you are already in the UK.

    Any documentary evidence that the family member provides must be the original (not a copy).

    Where a document is not in English or Welsh, the original must be accompanied by a fully certified translation by a professional translator. This translation must include details of the translator’s credentials and confirmation that it is an accurate translation of the original document. It must also be dated and include the original signature of the translator.

    The maintenance requirements for a family member of a Tier 4 (General) Student depends on the following circumstances:

    - the length of the course;
    - where the main applicant will be studying in the United Kingdom; and
    - whether the main applicant already has an established presence studying in the United Kingdom.

    How many months money does a family member of a Tier 4 (General) Student need

    A family member of a Tier 4 (General) student must show that he/she has enough money to cover his/her monthly living costs whilst the student is studying in the United Kingdom.

    The amount of money a family member has to show will depend on whether the student already has an established presence studying in the United Kingdom. Where a student has an established presence studying in the United Kingdom, the family member will need to show less money for living costs.

    A student has an established presence studying in the United Kingdom if:

    - He/she has completed a course that was at least six months long within their last period of leave, and this leave finished within the last four months; or
    - He/she is applying for continued study on a course where he/she has studied at least six months of that course and has been studying within the last four months; or
    - He/she is applying to continue in Tier 4 as a Sabbatical Officer or as a Postgraduate Doctor or Dentist and he/she has completed a course that was at least six months long within his/her last period of leave, and this leave finished within the last four months.

    A family member can qualify for the reduced maintenance levels whether he/she is applying from inside the United Kingdom or from overseas.

    Where a student does not have an established presence studying in the United Kingdom, the family member must show that he/she has money for his/her living costs for each month of the students course up, to a maximum of 9 months.

    A student with an established presence studying in the United Kingdom must show that he/she has money for his/her living costs for each month of his/her course up, to a maximum of 2 months.

    The family member of a Tier 4 (General) Student where the student does not have an established presence in the United Kingdom

    If the Tier 4 (General) Student is studying in inner London

    The family member of a Tier 4 (General) Student who is studying in inner London must have £533 per month up to a maximum of 9 months, to support himself/herself.

    If the Tier 4 (General) Student is studying in outer London or anywhere else in the United Kingdom

    The family member of a Tier 4 (General) Student who is studying in outer London or anywhere else in the United Kingdom must have £400 per month up to a maximum of 9 months, to support himself/herself.

    The family member of a Tier 4 (General) Student where the student does have an established presence in the United Kingdom

    If the Tier 4 (General) Student is studying in inner London

    The family member of a Tier 4 (General) Student who is studying in inner London must have 2 months maintenance of £533 per month, to support himself/herself.

    If the Tier 4 (General) Student is studying in outer London or anywhere else in the United Kingdom

    The family member of a Tier 4 (General) Student who is studying in outer London or anywhere else in the United Kingdom must have 2 months maintenance of £400 per month, to support himself/herself.

    You will need to show:

    - Personal bank or building society statements covering a 28 day period ending no more than one month before the date of the application; or
    - Building society passbook covering a 28 day period ending no more than one month before the date of the application.

    You will also need:

    - Letter from the bank confirming funds covering a 28 day period ending no more than one month before the date of the application.

    Remember the UKBA will only consider documents that are specific to the application and as described in the Guidance for Dependant Applications.

      As of 8 February 2010, London SAM still does not appear on the Tier 4 Register of Sponsors. They have released the following statement on their website:

      LondonSAM wishes to make the following announcement:

      LondonSAM’s Tier 4 Sponsorship Licence has been put on hold by UKBA. The College is continuing with its normal activities from guidance given by UKBA; it will carry on with its obligations as a Sponsor. There will not be any interruptions to any lectures.

      We are awaiting further clarification from UKBA. As soon as we have determined the reason, we will address the situation as soon as possible. Meanwhile, please note:

      1. Those who are enrolled with us at the moment will continue with their studies as normal.
      2. Students NOT attending lectures in accordance with their timetable will be reported to UKBA.
      3. For those students who have been granted visas and are on their way to study, the College will fulfil its obligations.
      4. Until clear guidance from UKBA is given, we will not be issuing any further visa letters.
      5. We will update this web site as soon as there is further development.

      • hello. can you pls inform me of the status of London Academy for Higher Education (LAHE)? The school has been suspended, but their agents said that it’s just waiting for the license from the HO, and that it has already been re-accredited by the BAC. Does it follow that once accreditation is given by the BAC, the license can now be re issued? Hope to hear clear answers soon! thanks.

  • i am worried about my a college , and a bout my visa, i came in the uk only resone to study i do not want any thing else , but i am in bad mood, because that is not fair to panic students about their study, i reckon if there is any problem you should sort it out before the students starting their courses

    however, how can i find a college or university , the time run out

    • Thanks for your comments Ray.

      I completely understand your frustration – I’m sure that as an international student in the UK, it must be a very frustrating and worrying time. But the key is not to panic too much.

      I think it would actually be worse if the UK Border Agency was to suspend all schools and colleges and only let new applicants come once an inspection has been carried out. This would almost certainly destroy the international student sector in the UK! But I concede, the current situation is stressful for students – but as long as your college has followed the rules then they – and their students – have nothing to fear. I think a major problem with all this change is bureaucracy – embassy staff aren’t doing what the rules specify they should e.g. many students having their visa application refused during an education provider’s sponsor licence suspension.

      I guess the key thing is to make sure your education provider and agent are legitimate. And if your college has their licence suspended, then keep in contact with them and put pressure on them as you’ve already paid your fees.

      Rayat London College’s sponsor licence is still suspended.

      It is impossible to know how long it will take for a school or college to be re-included on the Register of Sponsors, but it can take several months. The process is definitely a slow one; for example, there is a 32 day period following inspection set aside for exchanging letters!

      Whilst your college’s sponsor licence is suspended, the UK Border Agency advises you don’t travel. You should remain in contact with your college to defer the start date of your course.

      Have you been able to get any information from your college or agent?

    Plz help me, and tell about the status of Rayat London College as this college was suspended on 19/01/2010 and I have submitted my visa application on 31/12/2009 but my visa is still under process, so please help me and tell me the status of the college, how much more time will it take to come out from suspension list.

      As every individual case is different, there is no way to know exactly when the college will re-appear on the Register of Sponsors. Maybe it will never come back – but at least the UK Border Agency will contact you in this case.

      You should understand that it is a slow process and can take several months; following an inspection there are 32 days set aside for exchanging letters….

      Don’t worry about your visa application – it will have been put on hold until your college’s suspension is resolved.

      You can change college if you want, but you will lose any money paid to London SAM.

      They are currently trying to resolve the suspension of their sponsor licence and rleased the following statement on their website:

  • London Sam website is back to normal . I have contacted the college and spoke to Mr Dak patel him self he told me the inspection is gone really well and the college is expectong tier 4 A rating back within in a week or 2 i have spoken to some other staff members and they are saying they are very hope full of getting the license back any ways lets hope for the best

  • Thanks for your prompt reply to my mail…I feel that I am going to be in a very serious academic problem if there is no body to approach at the Bombay official representative of London SAM…though there is fair chance to change the college/university but it may take the time which is running short…at the same time I may face the visa problem in future…whereas the college authorites are not responding the problem in a very open and fair manners….therefore I seek your advise what I am suppose to do in this kind of critical situation…I shall be oblise if you could put some light on the issue keeping in mind my future…….with regards, yours
