Can I get a Refund if my College is Suspended From Tier 4?

In our normal lives we normally don’t think twice about being able to get a refund. However, refund policies of colleges and schools are a gray area, along with complaints and cancellations.

Because of the recent closure and suspension of many colleges in the United Kingdom – and given the sacrifices many students and their families have made – students are rightly concerned; they want their study abroad experience to meet their expectations and they certainly don’t want to be caught up in the current quagmire of UK Border Agency action. Whilst schools, colleges and agents can’t provide guarantees for every possible issue, the most reputable organisations will be quick set students’ minds at ease.

In other words, reputable operators should be able to provide students with policies that are, true especially in the case of refunds.
Many countries around the world provide protections for when things go wrong in consumer law. Many European countries have laws outlining what should happen in the event of cancellation or refund. However, these laws are in place to offer consumers protection against goods or services that do come up to scratch thus refunds are only available in these circumstances.

In the UK there is little protection for students looking at their college to refund their tuition fees if their sponsor licence is suspended or withdrawn. Like the Points Based System, UK legislators could take a further leaf out of Australia’s book, providing regulation of the international education sector. Australia has the Education Services for Overseas Students Act which sets out codes of practice and minimum standards expected from education providers in case of school closure.

The Australian’s have taken great steps to help genuine students who have been affected by school closures: when Melbourne International College closed, the Government waved the visa fee for new applications of some 4,700 affected students.

Refund Policies and Options

Many students are partly to blame for not knowing the refund policy of their school or college. Many neglect to properly read terms & conditions and expect that every agent and education provider will provide fee refunds in the same way. This is in fact, far from the truth.

Refund policies of UK schools and colleges are complicated, with different providers asking for different deposits, arrangement fees, accommodation booking fees, etc. More often than not, these fees are all non-refundable. In terms of tuition fees, there are a number of different policies, dependant on the amount and cut-off dates for refunds.

Students should take great care to familiarise themselves with their school or college’s terms & conditions. If you need any help in interpreting any documents, feel free to ask in the comments.

Mitigating Circumstances

It is definitely true that whilst many schools and colleges have established cancellation and refund policies, some education providers will be more sympathetic than their terms & conditions allow. Many education providers also want to protect their brand and so if a student really can’t come to start their studies, they’ll offer a full refund. As a logical person might think, those schools and colleges who are operating with integrity and morals will often apply common sense to a situation and assess the circumstances surrounding claims for refunds on an individual basis.

There are few education providers that will refund students their visa application fee. Some schools and colleges in the UK take proactive steps to protect their students: Education aBc in Oxford includes insurance with every registration.

The Role of Your Agent

Having applied to study in the UK through an approved agent, students should expect the official refund policy of the school or college to stand. This does appear to be common practice but students should note that agents may well charge for the work they’ve already carried out for you, which would obviously be non-refundable. Good agents will inform students up-front about their own refund policy and many will partially refund their charges to students in the event of course cancellation or visa refusal.

One tip that may apply to students is to look for agents that are registered travel agents or tour operators; they’ll often be required to have a much greater level of protection for customers. Tour operators in many countries are required to take out extensive liability insurance to cover you in case of bankruptcy and non-delivery of services, for example.

In the case of refunds and cancellations, agents’ hands to appear to be mostly tied; both agent and student are at the mercy of the education provider. The specific details of cancellation and refund policy are down to the schools and colleges themselves.

How Students can Complain

The British Council, English UK and the UK Language Schools’ Association administer the UK’s largest accreditation programme. They have also put in place a robust complaints procedure, which students can use to seek some remedy. In fact, all member schools and colleges should display posters with details of the scheme, written in multiple languages. The whole aim of the procedure is to find an amicable solution for both parties, if possible under the circumstances. Around 35 complaints are received, 3 or 4 of which are referred to the Independent Ombudsman for a decision.

English UK education providers are required to have:

  • Fair and reasonable terms & conditions;
  • Refund and cancellation policies must be clearly and publicly stated; and
  • All schools and colleges must provide accurate information on class size, hours study per week, tuition fees, payment options and accommodation.

If a school or college closes before a student completes their course, they can apply to get financial support from English UK’s Student Emergency Support Fund.

  • hi.i applied for a student visa 22nd march10.my sponsor was katherine and kings college london.their licence gt suspended 18th march and they informed me on 24th march.however this resulted a major delay in processing my application.my visa got rejected on the 27th june.due to the reason that i had minimum balance which was £7066 was short of £389 at the beginning of the month although the closing balance was over £9000.now the college is refusing to give me a refund.can u please advice me on how can i get a refund.their terms and conditions are as following.
    PAYMENT & REFUND
    The course fees advertised by the College is correct at time of issue, however the College reserves the right to change any course fees prior to the course commence date.
    The college is not responsible for your bank charges.UK bank charges will be added to your cost, and are applicable to all methods of payment accepted by the college.
    The College do not accept credit cards, debit cards and foreign cheques.
    All tuition fees are payable in full before the course commence date. In regard to overseas students, the college requires all outstanding balances to be cleared once visa applications are approved by UKBA.
    At the discretion of the college, students may be allowed to pay their fees by instalments, but a surcharge to cover additional administrative fees will be added to the tuition fees.
    Registration Fee and/or Administration Fee
    The registration fee and administration fee is not refundable, except in such situations described in 2.4.
    Registration fee is payable when registering with the college for the first time.
    Any registration and subscription fee for professional association is not refundable.
    Deposit
    Deposit is not refundable or transferable if the student decides to cancel an enrolment within one month of the original course starting date, except in such situations described in 3.7.2.
    If for reasons beyond the student’s reasonable control (UKBA regulation change, major disaster or major accident), the student’s ability to study in the United Kingdom is compromised, deposit may be refundable within one month of the original course starting date. This decision will be made on a case to case basis and the College reserves the right to charge up to three times of the registration / administration fee as cancellation fee.
    Deposit is refundable if the student decides to cancel an enrolment one month prior to the original course starting date, provided all original documents and receipts issued by the college are returned.
    Deposit is refundable if the student has been refused a visa to enter United Kingdom, provided:
    1. the student has not entered into UK.
    2. the student provides the college with the original ‘Refusal Letter” issued by British Consulate, and return all original documents and receipts for fees paid issued by the College.
    3. if the student has logged an appeal, the fee will only be refunded once the college receives documentary evidence that the appeal has been dismissed.
    The College will charge three times of the registration / administration fee as cancellation fee.
    If the visa refusal due to fraud, dishonesty or negligence of the student or the student’s representative, no deposit will be refunded.
    Once the student has obtained a CAS from the College, deposit will not be refunded unless the student can provide an acceptable and genuine reason to withdraw his/her application. In which case, the College reserves the right to charge up to three times of the registration / administration fee as cancellation fee.
    Deposit is not refundable or transferable once the student has obtained a visa using the college’s official documents and/or CAS.
    If a student decides to finish the course early or discontinues the course once the course has started, no part of tuition fees will be refunded or transferred except in such situations described in 2.4.
    If a student arrives late for the start of the course, takes a holiday during the course, or is asked to leave the college because of serious misconduct or poor attendance, no tuition fee or accommodation fee is to be refunded for the time missed.
    Tuition fee is not transferable.
    When accommodation is booked through the college, the booking fee (£50) and one month’s rent as a deposit should be paid in advance at least one month before the start of the course. No fee can be refunded if a student withdraws the booking at any time. The minimum of contracted period is 3 months.

  • Hi there. Please help. Enquiring on behalf of an international (Nepalese) student.
    OVTcollege licence withdrawn. Student studied for one year. Cant obviously do the second, though Student visa expires May 2011. Still has approx 1 month to find a new college. Problem- the costs, she has no money. So need to get SOME refund (of 7000 USD total). Its a chicken and egg thing.

    No terms and conditions available from OVT college (think their website is withdrawn now too).

      I’m afraid your education agent is acting unscrupulously – a cynic would say they don’t want to request a refund in order to protect their commission.

      All colleges must provide a refund where a student has had their visa application refused.

      I would suggest you contact the college direct to:

      Get your refund processed
      Report your agent for refusing to request a refund on your behalf

      I’m sure the college would want to know that an official agent has been breaching their terms and conditions and agency contract.

      If you provide me your agent’s details I will contact Albion College on your behalf – I have been speaking with the Director of Operations there in relation to some separate issues and would be happy to pick up the phone and speak with him for you.

    I have attended class just one month i.e NOV to DEM 2009 not more than that. I have enrolled in college through direct way.It is mentioned in the conditional letter that the total fees of course 4000 pound.I do have all documents till now.I don’t know what they gonna do………..damn.

    i paid £7400 for my 1 year diploma in tourism.but college issue letter £3500.know i asked principal to give my reciept of fees £7400…but they warn me they send my name to home office,,,only because i want my reciept….there is 15 hours class in a week but college provide teacher for 8 hours…i want to change my college because there is no study in my collge & no dicipline…..

    what is the rules for changing my college….i start my course in january 2010.
    my carrer is on ending stage….

    I came UK on sept 21 and my college started from Nov.For that reason i don’t like to studied there.However, I have attended my class from November to December, just one month.And after a months, i informed to the college that i want back to home country with my refunded money and my visa cancellation though legally and though i filled the refunded form also. At first college gave me the positive response but now they said refund can’t be provided.How can i refund the money that i haven’t attended the class which was 4000 pound for a year?

      Sorry to hear that your experience of studying in the UK for only a month was bad enough to make you return home!

      When the college first gave you a “positive response” with regards to your refund, did they do so in writing?

      Also, do you have a copy of the school’s terms and conditions? And what is the name of the college?

      Unfortunately, most colleges will not provide a refund once a student has started a course. This is why I asked whether you have confirmation in writing.

        The name of college is London college of Engineering and Management.Actually, they said that if we deposit 4000 pounds in once for two year course and they will return half of fees to us, later they said total cost was 4000 pound per year.But, unluckily we trust them and have no any written documents about that.If i haven’t join the class why it can’t be refunded? I always informed them about the matters but they give negligence to me and my father. Yesterday also i informed them but they said it is too late,but i was informed them before a months ago.Should i have to come to UK for refund and visa cancellation? If visa will not cancel can i come to UK which is about 27 months?

          However, I’m slightly confused; in your first comment, you said that you had attended classes at your college for 1 month (November – December). In your second comment you said that you had not attended classes at all. So which is it?

          Did the college provide you with full written terms and conditions when you enrolled? Did you enroll through an agent or with the college direct?

    My name is haseeb and i am from pakistan.i wanted to ask your kind advice on enrolnment issue in london colleg that i am facing.

    I apllied for student visa for uk but it was initially refused, but i appealed aganist the decision.Meanwhile, i put the course in hold in my college.Now that i have won my appeal,after almost 1.5 years, and asked the college for cas letters but they refused citing the reason as that they are fully booked.

    I asked the college for refund and they agreed and asked for the relevant documents.Those documents were subsequently sent and received by the college.They told me that my refund will be due on 8/05/10.However,till now i have not received the refund of the fees that i have depositd.

    I sent several emails to their refund coordinator but no response came back to me till now.

    I am worried sick and would greatly appreciate a good advice on this matter.The college i am refering to is london college of accountancy and it is a registered college.

    first of all I would like to appreciate your efforts and kind help towards the students.

    I would seek your advice in my case please, I applied for visa extension. At the time of admission and applying for visa extension the college was at the S.Register later on, Licence of college was revoked and suspended in two months period.

    while my application was at process/Hold UKBA didn’t tell me about the updated status about college nether they gave me any advice beside telling me to wait to hear from ukba.
    and now they have refused my visa application since college was not at S.Register at the time of decision which is not my mistake.
    I have got two options now:
    1, Appeal against the decision or
    2, Reapply for visa extension.
    Question 1:
    I’m appealing against the decision and in court I’ll provide new offer latter from another institute, I there any chance that I could win the appeal since there decision is right according to the facts at the decision time but I have had no hold of the situation ?
    Question 2:
    And, Now I have got no valid visa sticker on my passport and while my appeal is in process can I make a new application to home office or ask them to review my case ?

    is golders green college one of the suspended schools in london? i applied for my visa last feb. 04 under the tier 4 scheme, but sad to say, i havent received any calls from the embassy yet. what are the reasons behind these delays? id rather have it delayed than denied.. can you help me out? thanks…

      As of 20 April 2010 that college does appear on the Register and has an A (Trusted) rating.

      • Golders Green College has a B rating after suspension in May. They’re not trusted anymore that’s why they’re screwing the pockets of enrolled students before their visa expires.

    I am an overseas student. I took admission in BC College located in North West London and applied for visa on 30th of September 2009 in my country. I got my visa on 11th of November 2009 and arrived in UK 16th of November 2009, But when i visited my college, i came to know that BC College is closed as it cannot fulfil the requirement of the UK Border Agency. So. i find another college to start my studies.I send an email to migrantreporting@ukba.gsi.gov.uk, After that,I remind them many time but they don’t reply me still,
    Please give information,
    1. Can I get admission with another college without homeoffice reply?
    2. My admission was in diploma in business management in BC college,even I have master degree and more than three working experiences in my country, Can I switch my visa student into PSW or HSMP etc.

    We are asking for the refunds since 4 months, its from December’2009 we started the procedure of refunds. Due to various reasons like college’s refusal to issue visa letters, Suspension of the colleges, Visa refusal from the UK Embassy and Banning North Indian Students to take up Diploma Courses . Though two reasons were quite obvious for refund – Visa refusal from UK high commisssion and refusal of visa letters from the college . Still they are holding the fees. For rest two reasons (suspension of colleges and Banning north Indian Student for Diploma courses) no one was mentally prepared. Still when spoken to them they assured the immediate refunds with deduction of fees, charging from 200 – 500 pound.

    Now every day they make fresh excuse. Hamilton college asks for Withdrawal letter/withdrawal stamp on the Passport from the Embassy for refunding(Embassy do not issue any of such letter) along with deduction of 500 pound. After college receive such letter still refund can only be claimed after 6-8 weeks.

    London CAM says they will try to pay per student every month. We have ten students with them. And already 4 students have got visa refusal from the embassy. Still they say they are helpless. They can only do this much.

    What shall we do now?

    I would like to know ” what court action we can take against them and how a winding up order to close their business can be obtained. ” I do not want to harm them but still they should realise they are also abide to certain law and order. They cannot sleep peacefully making our life misearble. I am answerable to all 15 students who everyday come to my office. It is so difficult to face them.Please suggest. Waiting

    i am currently doing my NVQ courses at majestic college. We were informed by the institution that their license was suspended effective March 1, 2010 and that they are still making an appeal for it. Though we are very much scared what will happen to the college that will directly affect us as a student, we still decided to remain with the college… we are very much hopeful and prayerful for the positive outcome of the appeal.

    However, I just want to clarify Mr Daniel. Most of us actually belong to the old visa, not the Tier 4.. if the Tier 4 license of majestic college will be withdrawn or revoked, is it still legal for us to continue with our schooling? It says that old visa can still continue because prior to Tier 4, the college was on the DIUS approved register. Please clarify all these things to us. We are really confused.

    And if it still possible for us to continue even though the Tier 4 license is revoked, do you think the certificate that we will be getting ( NVQ courses) can be accepted by the Home office when applying for a working visa?

  • Dear Mr. Daniel,

    I am an agent based in north India. We have some 15 odd students who applied for tier 4 courses during sept. and oct. last month . And payed full course fees to their respective colleges.Colleges were all of A-rating. After the rules changed in January and unfortnately Colleges got suspened the refund of fees has become a nightmare for us.

    Though their terms and condition clearly mentioned that fees will be refunded fully, if visa letter is not provided by the college or if visa is refused from the embassy.
    In either case student is fully entitled to get the fees back. Then why are they not doing it. Can you suggest the ways of getting the fees back. Total fees of 15 students come out to be approx. 95 lakhs.

    Following are the colleges:

    Anglian College of London
    Hamilton College
    London College of Accounting And Management(London CAM)

    I will be very grateful if i get some advice from your end.

      I’m quite amazed that the terms and conditions you have from each of these colleges provide refunds if a visa letter is not issued. Does it include details on time frames?

      What are the colleges telling you the reason for the delay is? And do you have copies of all correspondence between you? How long have you been waiting for refunds?

      You could always threaten them with court action and then a winding up order – which will close their business – unless they process your refunds in the next 14/28 days.

    i am presently studying in majestic college in borehamwood. just recently, we have been informed by our assessors that the college was suspended and is petitioning for the suspension to be lifted. because of these, a lot of the students are getting worried and some of them have even cancelled their direct debit with the college for fear that they might not get their money back.Some of them are even paying roughly about 200 pounds per month.

    Upon hearing this, Charles Kelly which is the co-owner of the college has been rounding up the students who have cancelled their direct debits,blatantly threatening them of suspension if they will not make their payments on time.

    my question is, do these colleges have the right to ask for a payment from their students eventhough they are suspended for the time being? we are fearful that we wont get our money back if the suspension will result in the cancellation of their license.

    there is no clear refund policy in place at the moment and the students are getting worried sick. the college has never been helpful in any way by not issuing enough reassurance to the students.it seems all they are after for at the moment is to squeeze every juice of money out of their already struggling students.

      Their sponsor licence was suspended on 1 March 2010 – quite recently in the scheme of things.

      It can take schools and colleges anywhere from 3-6 weeks to several months to be inspected by the UK Border Agency, for a Sponsor Action Plan to be drafted if needed and to be re-included on the Register.

      You should keep checking the master list of college suspensions to see when your colleges suspension is resolved.

      Only the college and the UKBA will know for sure. After inspection, 32 days is set aside for correspondence, so it isn’t a quick process. Find out more on the timescales: what happens to my education provider if their licence is suspended?.

      Your application will have been placed on hold pending the UK Border Agency investigation.

      If you are under contract to pay your tuition fees in installments throughout the year, then you must continue to do so. Unless you change sponsor.

    my name is sandeep. i came to uk in sep08 through a university paid full fee but i left that uni and joined a college and finished advanced diploma in business management in sep09 and applied for pg diploma in business management from same college and applied for visa extension in nov09 and i gave my biometrics on 18dec09 to home office, but later on my college was suspended. now on 11march i got a letter that on 2march my college was not on list so they are refusing my application, they gave me 10 days to leave uk or i can appeal again. so what should i do now. i’m in dialoma …..plz help

    I came in uk on Zyceum College Jan-19,but the college was suspended before two days.still it was suspended and may be it will revoked.Now I want to change the college to another college.what is the proceedure for me to change this.where can I go for help to change the college.Or is there any option in the Home office.

    Good news is I got admission in different but question is

    1) I need to make fresh application along with new CAS number?
    2) I need to maintian funds in the UK as well again? (in this i dont even have bank yet)

      Do you mean Lyceum College?

      If you’re studying in London, you will need to show you have access to £800 per month for 2 months = £1,600.
      If you’re studying outside London, you will need to show you have access to £600 per month for 2 months = £1,200.

      You will be required to pay the relevant fee again and you will need to get a CAS from your new sponsor.

    I’ve already applied to extend my visa by current college which is
    became subject for suspension after a few weeks.

    I am trying to get my fee back, but i don’t know how?
    I am discussing of refund with them, but no results, they keep saying that, they cannot ,….
    I don’t know , should i take another college and let HomeOfice know that I’ve changed it?

      You should check your college’s terms & conditions?

      Where are you studying?

      If you want to put extra pressure on them, tell them you will begin legal action against them.

      If you want to change sponsor you can, but the procedure you need to follow depends if you got your student visa before or after 5 October 2009.

      You can apply for an extension, even while your college’s sponsor licence is suspended and your application will be placed on hold until the suspension is resolved. You will of course be permitted to stay in the UK during this time. In fact, life should remain normal for you.

      If your college’s sponsor licence is withdrawn permanently, your leave to enter the UK will be limited in the following way:

      - to 60 days if you were not involved in the reasons why your approved education provider had their licence withdrawn (the UKBA will not limit your permission to stay if you have less than six months left. You may want to apply for permission to stay with another approved education provider during this time);
      - immediately if the UKBA think you were involved in the reasons why your sponsor’s licence was withdrawn.

      So the UK Border Agency will definitely give you time to change education provider, unless you’ve broken the rules yourself.

      Changing sponsor under Tier 4 depends on when you were given your original student visa.

  • Is Golders Green College Suspended as a sponsor for Tier 4 in the UK?because i lodged my application last Feb.04 and until now I did not receive my visa yet.Thank u.

  • I don’t know the refund policy of Albion College. Since my visa application is still pending, I’m more okay with it rather than my visa being denied! I’m afraid I feel troubled and bothered by their suspension, but what can i do? All else is out of my control. I pray that their suspension will be lifted very very soon. Otherwise, I’ll think again about getting a refund…^^

    • Albion College terms & conditions:

      1. Once we have received your application, we will advise you on whether or not we will be able to offer you a place at the College and, wherever possible, issue you with an offer letter.
      2. We will then ask you for a deposit of at least towards the first year’s tuition fees, and when we have received this deposit, we will issue a CAS (Conformation of Acceptance for Studies) confirming that a place has been reserved for you on your intended programme. If you require a student visa to study in the UK, this CAS can then be used to apply for your visa. We will be happy to advise you on all aspects of the visa application process, and in most countries, we have representatives who will be able to help you.
      3. Deposit payments can be made by cheque or through bank transfer into our College account, details of which can be found on the fees page of our website.
      4. If a visa application is unsuccessful, the deposit will be returned less an administrative fee of £200. Before we return the deposit, we will need to see a copy of the visa rejection form and receive back the original acceptance letter.
      5. The tuition deposit is non-refundable except when the visa application has been unsuccessful.
      6. On arrival in the UK, you must report to the College within 72 hours.
      7. Except in exceptional circumstances, students will not be allowed to transfer from one programme to another once they have accepted a place on the programme or programmes offered
      8. If a student decides to leave the college, then notice of at least one term must be given.
      9. Students must ensure that they maintain an attendance rate of at least 80%. Students who fail to maintain this level will be reported immediately to the UK Border Agency.

      Although these are the school’s terms and conditions, it could be argued that these are exceptional circumstance. The most reputable colleges who also want to protect their image understand this – I think other schools and colleges can too, if a little pressure is applied!

      I applaud your attitude giliwness; we shouldn’t get so stressed about things that really are out of our control now.

        What is the new rules are for Tier 4?he is from punjab india.he done his 10+2 his all subject in punjabi language.he studied all subject in punjabi medium not in english.i think he is not able to get visa.what can he do know.college can’t help in this matter.because they want only money.not bother studentg is able to study or not.they play game just for money.what is education? they don’t know.
