Tier 4 Policy Guidance – Summary of New Tier 4 Rules

Checklist and PenAs you may be aware the rules for getting a UK visa are going to change:

  • From March 3rd 2010 students will need to be level B1 on the Common European Framework of Reference (CEFR) in order to qualify for a student visa. Level B1 is equivalent to an IELTS score of 3.5 – 4.5, which means between a good pre-intermediate level and intermediate. There is still some confusion about this.
  • From March 3rd, students on GSVs will only be allowed to work 10 hours a week, not 20 hours.
  • Make sure you don’t get refused by the embassy or at the airport because you can’t speak English. You can do this by ensuring  that you:
    • a) complete any online English test yourself; and
    • b) check that you can answer basic questions about yourself and your reasons for wanting to study in the UK. Recently, some students who had actually got their visas had them cancelled at the airport in Britain when they arrived. Checking your spoken English before you apply for a visa will help to prevent this.
  • At the beginning of April a ‘Highly Trusted Sponsors List’ will be issued. All schools wanting to offer courses to students needing a visa will have to apply to be on it.

I hope you will agree that it is in your best interests as well as your education provider’s to try to ensure that students have a high enough level of English to get a visa.

Please note: until March 3rd sponsors can still accept students at A2 level as usual therefore I would suggest that you send any applications that qualify as soon as possible so that they can be processed before the 3rd March deadline.

Government’s Latest Tier 4 Changes Cause Confusion

I love my country and have been a supporter of our current Government. However, the Home Secretary’s announcement on Saturday of a number of new tier 4 rules and announcing that they are effective immediately has left many scratching their head, including the UK Border Agency. The new Tier 4 rules are being brought in following a review in November, to finally stop the wide-spread abuse of the UK student visa system. With 30% of migrants who come to the UK being students, one can understand the need for change. However, I think a little more thought should have gone into it. The Tier 4 new rules announced, effective immediately, are:

  • A new minimum level of English is to be set at Intermediate level. This is roughly an IELTS 4.0 or TOIC 385 – 550.
  • All student migrants who are studying courses below degree level will have their working rights restricted to just 10 hours per week.
  • Any student migrants studying a course of less than six months will no longer be able to bring dependants to the UK with them. Migrant students studying longer courses can bring dependants, but they will have no right to work.
  • All applicants of courses below degree level will now have to check if their education provider is on a new register, the Highly Trusted Sponsors List.

These new tier 4 changes follow a review begun in November 2009 of Tier 4 under the Points Based System and is expected to cut applications in 2010 by tens of thousands. These new policy announcements come amid fierce criticism of the Government for the current Tier 4 system, with political opponents claiming that the system still allows terrorists and deliberate overstayers into the UK. These new changes come amid a huge overhaul of the student rules of the Points Based System. Over 200 bogus colleges have now been shut and by 2011 the Home Office hopes to have the most sophisticated immigration system in the world, allowing people to be checked both in and out of the country. I called the UK Border Agency this morning to get clarity on the above new rules. Surprise, surprise I was told that they had no idea what I was talking about. When I said to the telephone operator that the Home Secretary had announced that the rules were effective immedielty, she told me that the UK Border Agency had been informed of nothing by the Home Office and that as far as they were aware, the old rules still stood for applicants applying under Tier 4. So, who should we believe? As soon as we find out anything more concrete, we’ll post it here. We’d like to hear from anyone who has applications pending during these changes to Tier 4 rules.

We previously posted about the e-petition urging the Government not to destroy one of its strongest export industries, the English language teaching sector. Today the Government have responded and as expected, they’ve said nothing in the 79 words they released in their statement.

Major Tier 4 Changes Could Affect Everyone

The Government is on the threshold of destroying one of its strongest export industries, the English language teaching sector, worth billions of pounds annually to the UK in visible and invisible exports. Tier 4 of The PBS, launched in April, brought sweeping changes to the int’l education sector. The gov’t’s aim was to rid the UK of bogus colleges, which were not just a security threat but also a blot on the UK’s unassailable reputation in education. This work has not been completed. A further aim was to streamline the issuing of study visas. Some changes were welcome, others serve only to turn bona fide students away from the UK. The gov’t now aims to further restrict int’l students from studying in the UK. That will devastate this vibrant and highly professional industry, leading to mass redundancies in language schools, secondary schools, colleges & universities, with huge losses to the economy and Treasury. The English language is a crown Jewel – let’s protect and nurture it!

As you may now be aware the government plans to hold a major review of the PBS system this December.  It will cover the below focus areas:

  • Should the minimum level of qualification that can be studied through the PBS be raised from NQF level 3?
  • Should the minimum level of English language qualification that can be studied in the UK through the PBS be raised from CEFR level A2?
  • Should English language testing be introduced for all courses of NQF level 5 and below, including English language courses, and if so, through what mechanism?
  • Should access to vocational courses be restricted?
  • Should we introduce a differential approach for countries which have historically been sources of illegal migration, raising the minimum level of qualification and introducing stricter tests for  individuals from those higher risk countries?
  • Should we restrict the work rights attached to student visas?
  • Should we place limits on the progression of students on courses up the qualifications scale without their returning to their home countries?

These particular points could have a significant and detrimental effect on both education providers and students across all areas.

UK Tier 4 Changes: Two New Announcements

The UK Border Agency (UKBA) is due to launch the new sponsorship management process for Tier 4 of the points-based system on 5th October 2009. In line with this launch, the UKBA announced yesterday two new policies which will affect students under Tier 4. They centre:

  1. Extending the maintenance concession for Tier 4 students who are already in the UK.
  2. All students who apply after the 5th October will have their permission to stay in the UK tied to their Tier 4 sponsor.
