Hi,

I was just turned down for a Tier 4 Visa, and the grounds for refusal were appallingly thin. The visa officer claimed that my course began on the 1st of Sept. and since I applied on the 25th of August, there was inadequate time left for processing. Completely missing the fact that my visa letter mentioned an extension till November.
More seriously, they have alleged that my bank documents are false and that my bank confirms this. My bank has shown me the verification form they filled out, and they seem to have slipped up a bit and only written my first and middle names along with my wifes full name (she is the joint holder). But the Bank courtesy letter I sent with my app should have clarified everything, my connection to the joint holder etc.

I am sending the case for administrative review, but do not know what my chances are. I need to clear my name, and have a letter from the bank now, explaining their position in detail.
Any advice?

    Under the new Student Visa system (Tier 4) which will be implemented in March 2009, will studying A-Levels and GCSEs (both pre-university qualifications) in the UK still be allowed?

      Yes, students will still be able to come and study in the UK for their GCSEs and A-Levels. Following the changes, there will be 3 classes of ‘student’:

      - General: Students studying in Britain at or above degree level in a publicly funded institution, or engaging in more than 15 hours of study per week.

      - School: Students in full time study at an independent school up to the age of 18. Working hours are the same as the general student category but dependents are not permitted.

      - Study through Work: Students on courses of work experience or placements. Working hours will be the same as the other two categories and dependents will be permitted in instances where the principal applicant will be in the country in excess of 12 months.

      So yes, pre-university students will still be eligible to come to the UK.

      • Hi there, Thanks a lot for your answers. But what you said about the age for indepedent schools kinda alarmed me. I will have turned 21 by September 2009. Can I not study A Levels if I’m older than 18? Actually I’ll be studying A Levels either at a sixth form college or a further education college but I’m not sure if they can be called “independent schools.” And A Level is below degree level so will I more likely be classed under “School”? I’m really confused. Please help me. Thanks a lot – Mike

    there is one querry…i just want to ask u one thing tht the student who have there visa extension in jan,,,they should also have to follow the the new tier 4 rule…becoz i think my college doesnt comes in tier 4….but i am th regular student of the college..apart from this also have my final selection in british army in feb nd they gonna give me the letter for tht,,,so home office would consider that statement by army?
    becoz as u said that tier4 is going to apply in march 2009,,,so the extension which are to be done before march 2009 will be done in the similar way which is used to be done before? becoz i dnt think my college comes in tier 4 yet…plz help me out i am really very worried.becoz i my visa is goin to be expired in jan..

        yes it is possible,but u have to pass sum tests…i have also been to final selection for the british army in sep 2008 but they deffered me because of my running time…as they could put me back in the selection hopefully in this feb 2009 but only after getting my paasport back from home office…i just want to confirm wheather the home office going to consider my letter which is issued by army office.

I want to extend it but there is one thing I want to ask for those students applying for extension will also need to show 9,600 pounds in their personal account maintained in UK or where. Kindly clear this problem,Or they just need to show their funds are coming from their sponsors of their country.

      u dnt need to show 9600 pounds in ur account,,this is only for th students who r goin to apply for fresh student visa frm sum other countries except E.U ones…u only need to show tht ur gettin ur money from ur sponsors regularly…..

      Yes, you will English level is requirement of Tier 4. You must be able to study a course which is CEFR A2 or higher. As a very rough guide, you need to be at a level of pre-intermediate or upwards.

    I have beej told by people that there would be new rules for dependents in April 2009. The change would mean that people with dependent visas can’t work full time any more. Is that correct?
    Also, currently under the Tier 1 (general), a spouse can work full time. If such a rule comes in would it effect exsisting Visa holders?

    Advise would be appreciated.

      Yes you’re right, if you apply for a new visa or an extension, after the new rules have come in, then you will have to follow the Tier 4 rules.

    • The rules state that it is the student who must show the funds and not their sponsor. It has also been recommended that if you receive the funds from a sponsor, have them to write a letter stating that the money is a gift to you and that they will not demand you give it back at any time. This letter is key as it establishes access to regular funds, with no threat of withdrawal.

      The IELTS level required varies from course to course and school to school. Under the new Tier 4 visa rules, you just need to demonstrate that you have achieved an elementary level of English. If you want to apply for a course in the UK, you’ll need a bare minimum of 5.5 in the IELTS, 6.5 if it’s a good university.

    I have friend in Birmingham his french guy working in Birmingham now he helped me to enroll in UCB university and I just got my programme offered now Business Enterprises. Do you think my sponsor will be granted to do so ? I mean to sponsor everything i need there? Do you think is this possibility as I always heard only for a health care related for the student visa.

  • Hi my visa is refused because of incomplete information in my visa letter under TIER 4 rules.I scored 10 points but did not score 30 points for visa letter. Embasy refused my visa because my Nationality was not mentioned in the Visa letter. My University has asked me to apply again for the Visa with new Visa letter. Please tell me if we can reapply for the visa under TIER 4 rules.

      What a nightmare with your application! I hate it when applications are refused on such a technicality.

      You can of course just make a fresh application with a new visa letter. You will have to pay the visa fee again, unfortunately. Although as this was a mistake from the education provider, I would probably strongly peruse the college to cover the 2nd application fee.

      The chance of you getting a visa to study in the UK has nothing to do with where you choose to study or the course you enrol on. As long as you meet all the requirements set out under the Tier 4 system, you will be granted permission to study in the UK. Roughly speaking, the requirements are:

      - Studying at a licenced education provider
      - Follow a course of level CEFR A2 or above
      - Having sufficient funds to cover tuition fees and maintenance costs

      You should have submitted all the documents you used when you enrolled on your course along with your visa application (excluding this like artwork portfolios). This information is clearly displayed on the Appendix 8 form you have to complete.

      If the visa letter only mentions your diploma, then you should only submit your diploma certificate with your application. If it mentions both, you need to submit both.

      As of 3 February 2010 Rayat London College does not appear on the Tier 4 Register of Sponsors so you will not be able to get a UK Student Visa.

      You can change education provider under the Tier 4 system. It all depends on when you got your visa: before or after 5 October 2009 – before in your case.

      Here’s the blurb from the UKBA website:

      Switching if the student made their current Tier 4 application before 5 October 2009

      If a student wants to switch to a new Tier 4 sponsor and their current permission to enter or stay in the United Kingdom is based on an application made before 5 October 2009, they must obtain our permission to switch.

      The student (or their parent or guardian, in the case of a child student) must email MigrantReporting@ukba.gsi.gov.uk to ask us for permission. The email message must include details of the proposed change, including:

      * the new sponsor’s name, address and contact details; and
      * details of the new course, including the start and end date.

      We will send an acknowledgement to confirm that we have received the request.

      We will give permission for the migrant to change sponsors if we can confirm that:

      * the institution that they want to move to is licensed by us under the relevant tier 4 category;
      * that institution wants to be the migrant’s new sponsor; and
      * the new course meets the requirements set out in this guidance.

      Once the migrant has emailed us about a change of sponsor and has received an acknowledgement, they can begin their new course without waiting for our permission – but this will be at their own risk, as we may refuse to grant this permission.

      If a migrant does not ask us for permission before switching to a new institution, we may curtail their permission to be in the United Kingdom as a tier 4 student.

      If the migrant’s existing permission to stay as a tier 4 student will expire before the course with the new sponsor finishes, the migrant must apply to us to extend their permission to stay. They can choose to apply immediately, or they can wait until shortly before their existing permission expires.

      If the new course is shorter than the original one, the migrant must tell us immediately.
      Timing of a change of sponsorship

      If the migrant is changing sponsor in order to take up a new course after their current course has finished, the new sponsor will be responsible for them as soon as we have granted them further permission to stay.

      (For example, a migrant who is due to finish a course with Sponsor A on 30 September 2009 may want to start a new course with Sponsor B on 20 October 2009. If they apply to extend their permission to stay in April 2009 and we grant this permission from 31 May 2009, Sponsor B will take over responsibility for them from that date, even though they are still studying with Sponsor A.)

      Sponsors may want to make sure that migrants do not apply to extend their permission too early, as this could mean that they are being sponsored by another education provider while they are still part-way through a course with their original provider.

The colleges in london are the college with names but some colleges doesn’t even exist. dolphin edu. consultncy of nepal ,consultant and college XYZ college representative ate my friends 4800 pounds and that college in not in london and now he is studing in a college in woolwich. how can my friend get money . can u plz help? ur response will b highly appreciated.

      You can show the funds in a parent or guardian’s account. You will also have to submit documents confirming your relationship if you do this – e.g. your birth certificate to show your relationship to your parents, along with your parents’ bank statements.

      How are you getting along with your administrative review? There is little information on how long they take – is yours still in process or have you had a result? It sounds from the details you provided that you really should have got your visa. I really share your frustration!

      Most students seem to make a fresh application when facing your situation. I assume that once the Embassy receive the bank’s explanation, all should be well, but I wouldn’t be surprised if they refused your application just to collect the fee for a new, fresh application!

      Changing to a new education provider all depends on when you got your visa:

      If you got your tier 4 student visa before 5 October 2009

      You will have to obtain permission from the UK Border Agency to change education provider. You can ask for this permission by sending an email to MigrantReporting @ukba.gsi.gov.uk. You must include the following details:

      - the new sponsor’s name, address and contact details; and
      - details of the new course, including the start and end date; and
      - if the new course is shorter or longer than your current course

      The UK Border Agency will write to you confirming they’ve received your request. As long as they can confirm the following information, you will be given permission to change tier 4 sponsors:

      Once you have emailed the UK Border Agency with the above information and have received an acknowledgment from them you can actually start your new course without waiting for the result of your request. However, this is at your own risk as the UK Border Agency may well decide to refuse you permission to switch sponsors.

      If you fail to ask the UK Border Agency for their permission to switch sponsors you’re permission to stay in the United Kingdom as a student will be limited.

      If you got your tier 4 student visa after 5 October 2009

      It is much simpler to change education provider in this situation. You just have to make a new Tier 4 (General) Student visa application supported with a new visa letter of confirmation of acceptance for studies from your new tier 4 sponsor.

      You will not be able to start your new course until your new visa application is approved by the UK Border Agency. You are free to leave your current sponsor but do so entirely at your own risk, as the UKBA may refuse your application meaning you may not be able to return to your original course.

              If you are in London, you will need to show you have access to £800 per month, for a maximum of 2 months = £1,600.

              If you are outside London, you will need to show you have access to £600 per month, for a maximum of 2 months = £1,200.

      It could be quite tricky to change college during its suspension from the tier 4 sponsors register and will depend entirely on the college’s terms & conditions. In most cases, schools or colleges will only process a refund upon receipt of original visa refusal documents. Whilst your application is on hold while the college addresses the UK Border Agency’s concerns, you may not be refused your tier 4 (general) student visa application and would therefore not be in possession of the required documents.

      I’ll answer both your comments in the one response, if that’s OK.

      The only people who’d you potentially have to explain your study gap to will be any school or college to which you apply. But, they may not be interested to know. Judging by your post, I assume that you’re worried about your education history when it comes to applying for a UK student visa.

      Following the introduciton of Tier 4 of the Points Based System by the UK Border Agency, this kind of subjective measure of applicants has been removed. So, as long as you fully satisfy the criteria set out under Tier 4 you should be fine. When did you take your IELTS test? As long as it is still valid when you apply for your visa then you will have no problems.

      Changing to a new education provider all depends on when you got your visa:

      If you got your tier 4 student visa before 5 October 2009

      You will have to obtain permission from the UK Border Agency to change education provider. You can ask for this permission by sending an email to MigrantReporting@ukba.gsi.gov.uk. You must include the following details:

      - the new sponsor’s name, address and contact details; and
      - details of the new course, including the start and end date; and
      - if the new course is shorter or longer than your current course

      The UK Border Agency will write to you confirming they’ve received your request. As long as they can confirm the following information, you will be given permission to change tier 4 sponsors:

      - your new education provider is currently licenced under the Tier 4 Register of Sponsors; and

      I’m sure your friends haven’t been deported for no reasons whatsoever, and I don’t think the UK Government is demonising Mulsims, Pakistanis or students in general.

      The student visa route into the UK has long been abused and the Government has decided to act out given the huge media interest. And I think the points you’ve raised are all fire-stormed by the British media, making the whole situation worse.

    I am a student of eCollege London. Recently my college has been suspended. I am married & my husband want to apply for visa as my depedent. Is there any problem to get visa for him as my college is suspended.I am too much worry.
